State Specific Question About: CALIFORNIA (CA)

We issued a 3 day perform or quit notice on a resident who had an unauthorized guest in his unit for more than the 14 days allowed. He said he would abide by the rules and found another residence for his guest (he even showed us a deposit on another unit he acquired for the guest). About two weeks have gone by and it appears the same overnight guest is back. Do we have to issue another 3 day perform or quit? We do have some security footage at the building, however, for the past week, he has been deliberately blocking the camera (ring) with his body, boxes, etc, so that his unauthorized guest can enter the unit basically unseen. Any help on this matter would be great. This resident is about 4 months into his one year lease. Thank you! --141.126.xxx.xxx

This is an ongoing problem for us. We have a lots of tenants that just think they can move in anyone that they want. We are adding the new language to our lease that will require the tenant to submit an application on anyone that stays 3 night in 7 or 6 nights in 30. We hope this will solve the problem.

In January we evicted a tenant who have her felon boyfriend living there. She was calling the police and saying he's do this or that. Then she would move him back in. 3rd time I sent her packing. --108.196.x.xx

AllyM, I had a tenant whose boyfriend was only a "guest" except he was there all the time, causing trouble, police getting called, fighting with her teenage son, etc. And listing our address as his...so not a GUEST but a RESIDENT.

I do want to know who is living in my property.

And how would you know if he was a criminal without a background check? --173.22.xx.xx

One of our tenants called about something and mentioned her fiance and told me he was renting his condo while they looked for a house to buy I sent him an application which he completed which allowed me to do a standard screening. He was fine and I added him to the lease.

I would tell your tenant that since his friend has stayed beyond the allowable guest time limit he needs to complete an application or leave. The worst that can happen is he A) doesn't qualify or B) he does and you add him to the lease. If it turns out he falls option A then proceed with an eviction notice. --75.181.xxx.xx
