State Specific Question About: CALIFORNIA (CA)

I am in the process of evicting a tenant. There is no lease agreement, and I filled out a 60 day notice and went down to the courthouse located closest to the subject property and paid for a sheriff to deliver the notice. The notice has been delivered and I want to know if there is anything else I need to do or give out as I am awaiting the eviction process? I want to make sure I am taking care of everything up front. Is there anything else I need to do to evict the tenant aside from giving them notice? --107.139.xxx.xx

I'm sorry, I don't think you were too clear. An eviction if a process that goes through the courts. A landlord can not evict a tenant themselves, they can only "ask" them to move out via the proper notices. If you know how to fill out an Unlawful Detainer Action and you file it with the court, then you as the landlord are acting as your own attorney...

Without a lease/contract, it is hard to ask for back rent or damages during an eviction. But once the tenant is out, in small claims court you can ask for those kinds of things. You should consult with an eviction attorney. Good luck. --47.156.xx.xx

I am not asking for back rent or damages, I want to sell my house and have delivered a 60 day notice to the tenant who is currently occupying my home. I simply want them out because I am now selling. I have filed a 60 day notice, and the sheriff's have served them said 60 day notice. I need to know if there are any other steps I need to take during the 60 day period in order to successfully move this process along. --107.139.xxx.xx

As you already know, once you have accepted rent from an occupant, they have rights as a tenant, even without a written contract. Notice to terminate a tenancy can be 30, 60 or 90 days, depending how long they lived on the property and if the rent if form HUD or Section 8.

You could have served them the notice yourself, you didn't need a Sheriff to do that, but it was a good idea as proof of service.

Since you have to give a notice, then I believe the tenant wasn't really evicted. So two weeks before the tenant is scheduled to move out, you must offer them a Pre-Move-Out inspection. Where as you document any damages go things you plan on deduction from their deposit. Such as carpet cleaning, fixing holes in walls, etc. This give them an opportunity to fix things themselves and not loose any of their deposits.

IF they don't want a pre-move-out inspection, then get that in writing....

Then see if they have started packing and any signs that they will move-out as agreed. --47.156.xx.xx

As Robert J. says, you need to offer a pre-moveout inspection two weeks before the end of the 60-day notice. This gives them a chance to fix any damage they caused before moving out. Do this in writing and have proof that you offered it to them. They may not take you up on it, but make sure you can prove you offered it at least two weeks before the moveout date.

If you're lucky, they will just move at the end of the 60-day period. If they don't move out, THEN you have to file for eviction. --24.130.xx.xx
