My (I only do MTM) rental agreement is 4 pages and I wonder if its too long turning some potential renters off, but everytime I look at it I see things that I feel I need however I also see here from people that seems to always say for every problem others raise here that they have that problem covered in THEIR lease/rental agreement.

I'm wondering how long is your agreements then. Has anyone ever posted what they thought was a perfect or near perfect agreement? Yes I know there are state specific laws and I'm sure its a long a tedious thing to do,.. but has anyone had theirs critiqued here? --71.192.xxx.xxx

Well yes,..I certainly wouldn't apply unless I saw an agreement.

As far as content vs lenght,..certainly thats why I'm asking because I can't think of anything I would remove yet it seems like others say "I have that covered in mine" to just about any problem,.. --71.192.xxx.xxx

Hummm interesting. But how do they know things like no smoking on premises, no pets, no noise after 10 pm, no parties,hazardous materials etc. and a bunch of other things?

I just foresee that I might get someone in that has their idea of what a tenant should be and what is or is not expected of them. In my first building years ago I didn't have much of an agreement and for instance had a couple of guys that were rebuilding their motorcycle in the living room. My statement of not having anything hazardous etc. did not work because in their opinion they didn't consider it so.

Now its true, I don't now still don't have a clause of no motorcycle rebuilding in the unit,...

6 pages (front and back of 3 pieces of paper). No issues. I sent it out in PDF form the day before we meet to sign.

Unless required by law to use specific verbiage, write your lease in language a 5th grader can understand. I got rid of a lot of there "hereins" and "heretofores" and "witnesseths"... these are not required in my state. --173.19.xx.xxx

Mark, my rental agreements both MTM & fixed term are 5 1/2 pages long. I use 14 point type & cover most of the each page. I also have a list of house rules which is several pages long depending upon the property. These house rules are referenced in the rental agreement & are stapled to it. Their move in packets also contains, the required lead info, a statement of condition, a SD form from the bank and a receipt for monies paid which specifies what the monies were applied to. Well folks here is the exception...

Oregon transfers possession and control from the owner to the tenant when the home is rented.

LL can't even come onto the property except roughly 5 reasons.. one of them is fire!

LL/Tenant is specific in some areas and not in others or simply does not address common things..so your rental agreement needs to spell out exactly what is needed or required..

In 30 + years.. I've not lost in court.. with specific contract language that is plain and simple...but covers many items... Oh and like buying a house, it's about 80 pages --162.247.xx.xx

10 pages. In addition to 2 pages of disclosures, a 2 page inspection checklist, and 5 more pages of addenda. I don't think anyone has ever asked to see it ahead of time.

Mine is 9 or 10 pages depending upon whether they have pets or not. I haven't had any issues with tenants not wanting to sign it. One thing I do is print it double-sided. To me, that makes it seem shorter. --70.178.x.xx

I used to work for the Department of Engineering in a major municipality. They were the ones who managed all the capital improvements projects. I remember the woman whose job it was to manage and bind all the contracts/bid packages/etc. She had been there for decades. "I remember when these contracts were 3 pages long," she told me one day, when she was binding something that ran at least 100 pages. "And I remember every guy that made us modify our contract..."

I think of her every time I add a new paragraph to my lease, or modify the way something is worded... My lease started off at 10 pages, and continues to be 10 pages, but it's been modified around 20 times since 2010. --96.46.xxx.xx

They get to read the lease before signing it, of course! And most LL would allow them to take a copy of it to their attorney (or a free public service one) to have them look it over.

Mine is 15 pages long, plus an instruction page. As mentioned above by Kyle[IN], I have one page of the application where I list the important/controversial items, such as no smoking, no pets, etc. And I have them initial each of those on the application. Hold on to your seat! Mine is 27 pages long, single spaced.

Over 40 years, lots of houses, and 300+ court evictions, every time I was surprised in court, had to hassle with a resident, or learned something great here online I added it to my lease.

Our judge talks to our assoc every year so I take LOTS of notes and adjust my lease to a judge's thinking.

If it's important or will protect me it's in the lease. No addendums because I watched he judge throw out addedums in court.

A judge told me it was the best lease he ever saw because it gave him a guideline to rule on - costs for painting, repairs, how the last month is calculated...

It includes a 4 page inspection, a page to head off mold problems, a page to head off bedbug issues, a page of Standard Cleaning and Repair Charges, vaping, e-cigs, death of tenant, monies are applied to the unpaid balance NOT to s specific fee, unpaid balance is considered unpaid rent and cause for eviction, move out packet/checklist for cleaning, transferring homes within our company, grills 15 feet away when in use, 4 Emergency Contacts per adult with signed authorization to deliver court notices to Granny, when a pet dies, authorization for Autodraft from their bank account, PayDayPlan rent...

My lease is designed to protect me AND make me money. If I want it done it's spelled out in the lease. SELDOM do I run into a sang that is not already laid out in the lease.

Sooo many of the questions and problems posted here should be covered by their lease.

Paper is cheap, cheaper than a minute spent trying to solve a resident issue or a He said/She said in court.

Even if it's written in your lease, the sit down lease signing review/orientation is incredibly valuable. Reviewing the lease highlights has greatly reduced our phone calls and "discipline" issues.

I believe most people will comply with reasonable rules IF they know the rules. It's OUR job to set the expectations and tell them the rules.

In 40 years, averaging 50 new leases per year I've never had ANYONE even mention the length of the lease.

Mark, I think asking to see our complete rental agreements is like asking for a list of our handymen / contractors. Not everyone will be willing to share their agreements.

Like others on this site, I started with a basic lease that I acquired somewhere. Then whenever an issue cane up, a clause was ruled illegal or I saw a good clause I modified my rental agreements.

I suggest that you get a copy of the 6th edition of Property Management for Massachusetts Rental Owners put out by HAP Housing(413.233.1500). Not only does it have some excellent info on rental agreements, it also has good info on owning & managing rental property in MA. --72.93.xxx.x

One attorney told me that if too many specific things are listed a judge might say that another particular problem wasn't covered. Statements that are more "blanket" type or general such as: Do nothing to change the walls of the rental. Would be looked at by a judge more favorably. But I do list things specific to a building such as one car must use the garage which is a common area. --73.33.xxx.xxx

Mine is 9 pages, shrunk from 16 a few years ago with replacement verbiage for parking, -account payments- and removed grace, some can not but when you can -ERASE GRACE, say it again Erase Grace, sounds good doesn't it, why reward bad behavior??
