My delinquent renters left the property, but left a massive amount of belongings. She told me they were leaving and they left the keys on the counters. In a separate phone call, she told me they were already in Tennessee. After we realized they left so many belongings (honestly...it's like hoarders in there), we filed an eviction and just received the Writ of Possession today.
Do we need to wait another 7 days before beginning to remove their stuff, even though they are gone?
Has anyone else gone through this? Thanks!
Also, I don't think they are even aware of the eviction, judging by the open mailbox full of mail that obviously isn't being forwarded. (we used tack & mail, since we just wanted legal possession) Could it somehow come back on us since they didn't even know about it? --74.176.xxx.xxx |

This is in Georgia, correct?
Your tenants have vacated the rental property. Begin removing what they left behind (hopefully you can either donate it, your rental is in a neighborhood where it disappears within minutes of hitting the curb or the garbage folks will pick it up at their next scheduled day for doing so).
Georgia tends to be a very landlord friendly state. It's not going to come back to bite you. You've got your Writ of Possession from the court.

Yes, it is in Georgia.
Unfortunately, it's pretty rural. We are planning to have a dumpster brought in to dispose of the things that can't be donated. It's going to take us a while to get it all out.

Keys = possession. Donate what you can, keep the receipts for tax write-off. Separate metal items and take to the local scrap metal yard. Sometimes I get $25 to $50, not much I know but its better than paying to throw it away. Put the rest by the curb, locals usually haul away some of it. If the remaining is more than the garbageman will take you are stuck paying to throw it away, deduct from security deposit if anything is left. --96.236.xxx.xxx |

Check your state laws regarding landlord's responsibility for abandoned property. You may get a surprise.
Some states require abandoned property to be cataloged by landlord and stored, and for landlord to notify ex-tenant that he is holding the property for them, subject to landlord's right to dispose of the property after a specified period of time.

This is normal LLing.
I don't know your exact laws but I would not toss anything of value without PROOF I did everything possibel to contact the res.
My FAVORITE: we deliver the abandoned stuff safely to their Emergency Contact!
TEXT the former res -
"Mary, Please reply with a YES or NO to this statement: you are fully out and giving permission to dispose of any remaining personal property. If we do not receive a text reply by (date) we will consider all items abandoned and dispose them."
Take TONS of photos to shwo what was left and consider if these items have value or are trash.
I cannot recall the last time anyone left anything of value. Broken furniture, stained mattresses, non-functioning TVs...
CAUTION: leaving lots of stuff is also an indication of a bedbug infestation. Inspect carefully NOW!

I inherited a hoarder/hog a decade or so ago. when I got him out, I called a professional junk hauler (meaning one who advertises and has been in business for years, not a CL spur of the moment guy). I had him remove everything, including drop ceiling and the paneling he could easily rip down (which was most). they pulled out he carpeting.
They came for a 450 square foot apartment with three trailers and if I recall 4 or 5 helpers. They backed the trailers one each side of the front door. the extra trailer moved into place when one of the others went to the dump or wherever they took the metal. they hopped out of the trucks and went to work. Off came the front door and one of the front windows.
EVERYTHING with any miniscule amount of metal went in the one trailer and everything else in the other.
point is, it won't take long to empty it out if you hire it out to someone who knows what they're doing. --72.95.xx.xxx |

Thanks for the verification, Gail. It was my understanding that I wasn't required to keep the stuff once I had the Writ of Possession.
Nicole, I hadn't even thought of hiring it out. That's a great idea!

What I am trying to avoid is the res suing me for throwing away "her great grandmother's wedding ring".
Judges are flaky, they do what they want. Just because the writ MIGHT give you the right to everything in the home, that does not mean the judge (maybe a different judge than the first one) will penalize you for throwing away "great grandmother's wedding ring".
I had a 400 woman who could not fit into the chair in the courtroom cry in front of the judge because my cleaner had tossed her ROLLER BLADES!!! I can't make this stuff up!
I handed her the move out photos and asked her to point out the blades in the photos - of course they were not there.
Take TONS of photos to prove what is there, try contacting her every way possible, document each of those attempts to prove you made every effort to communicate with the res.
Meanwhile, toss the spoilables, bag up all else, stack it in the center of the room or the garage, and start cleaning/painting.
And don't let this get to you. It's our new culture.
