Tenant is liable for the sewer bill by lease agreement, although it remains in my LLCs name. It is $200 past due and about to be sent to collections. Even though the lease says sewer bill is paid before rent, eviction lawyer says court will still look at it as non-rent, thus making collection and/or eviction much more difficult than failure to pay rent. Lawyer requests a series of registered letters proving the tenant was given multiple notices to pay the sewer bill. Eviction fee is $400, trying to collect back utility payments, is additional cost for garnishments, if even possible. Tenant is always careful to pay rent on time or will voluntarily pay the late fee to square the rent account. Continue to eat the $79/mo sewer bill or what? --162.229.xx.xxx

Have you sent a notice to the Tenant letting them know the bill is delinquent ? What has the Tenant said in regards to paying the bill? I have seen a lot billing issues with sewer bills so you need to make sure the Tenant knows they owe! --73.236.xxx.xxx

Can't raise rent in the middle of the lease term...I have sent the bill, printed by the sewer company, many times to the tenant. Tenant always lies and says it is paid up and slams the door in my face or slams the phone down when I bring it up (and tenant now wants door hinge fixed and new caulk around tub.) --162.229.xx.xxx

If the sewer bill is in the LLC, I would pay it so it doesn't go to collections.

How does the lease address who is responsible for the sewer bill?

If the lease is written that tenant is responsible for paying the LLC for sewer charges, then I would think lessee is in violation of lease, and could be evicted on this alone, breach of contract.

Lawyer, wanting letters showing LLC asking for reimbursement, probably wanting to show court your LLC is letting tenant know this fee is due.

Lease terms:

Tenant shall: Pay all utilities when due including, if applicable, electric, gas, water, and trash removal. Tenant shall make arrangements for such services to be assigned to Tenant prior to occupancy and shall maintain such accounts/services (and, when necessary, provide heat for the building) throughout the term of the lease. (Sewer bill stays in name of LANDLORD, but is also paid by Tenant).

Tenant agrees to pay sewer bill when due and if not, will pay Landlord a late payment fee of $20/da. _JF__ Initial here

If the 'fail to pay' is considered a material breach, I should be able to evict. If non-material breach, I may only be able to sue for amounts owed... maybe? --162.229.xx.xxx

If you're dealing with m s d you're toast. They are one notch better than I s i s on my list. Sounds like you have a section 8 tenant. M s d has sued me in a similar situation. They don't follow any rules as you know if you're dealing with them. I use a flat fee eviction attorney. 675 and they're out. If section 8 involve the caseworker. If not, prepare to file suit at some point. --70.195.xx.xxx

If it is section 8, you may try going through the caseworker. Utilities must be paid up to stay.

I'd tell them that door hinges don't break unless you slam doors...
