I'm about to sign a new lease and want to add a clause that prohibits the tenant from keeping products that produce a strong odor in their unit. As background, I just had a tenant leave and the marijuana odor was profound. I've had other tenants using so may essential oils that the smells exit their units and fills the lobbies. I even had a tenant once who kept 5-gallon buckets of fertilizer in their apartment. Is there one clause that prohibits this sort of thing?

A general "not become a nuisance to neighbors" might help, especially if this is a multi-family unit where it's easy for Person X to smell Person Y's odors. However, if it's a single family house, this will be a challenge.
Rather than let someone rent a house from you and afterwards try to exclude the odors, be proactive and visit their CURRENT house during screening and take a sniff. Whatever their house smells like today...that's what YOUR house will smell like 2-3 months after they move in.
If you are not available or they live out of town, a local REALTOR might do this step for $30. Just to stop by and have them sign a form, get pictures of pets, etc. Whatever it takes. Find a reason for the person to open the door long enough for you or your representative to get an eye full and nose full of what their home looks/smells like.
Some people's homes just stink for whatever reason, even without chemicals. Poor hygiene, medical conditions, bad housekeeping, etc. I don't think you can account for every situation in a lease, so your best bet is to check it out before hand. --173.19.xx.xxx |

We do put a clause in the lease that specifies that there should be no odors left behind when they leave or remediation will be at their expense. (We have charged one tenant who left a very rank smelling garbage can in the garage and the odor gravitated into the wall boards. We can clean or repaint anything but odor is our toughest obstacle.
My lease is clear: "Smoking may increase exit cleaning costs due to odor and residue. Smoking is prohibited inside the home. This includes any tobacco product, marijuana, e-cigarettes, vaping, etc."
(I cannot be the smoking police inside each home to stop them from smoking but at least it's posted in the lease!)
Sid is on it. I push the 2 Minute In Home Visit for EVERY LL before final approval! The ONLY way to know what YOUR rental will smell like is to visit their current residence.
I pay a helper $25 to go within 24 hours. Additional $25 for neighboring counties. Distance: I call a small realtor office and pay $50. Well worth the money time and hassle.
2 minutes might have saved you thousand$$$!
I can "track" essential oil wearers thru the grocery store. They leave their scent in each dept!

Thanks for the input thus far. As a clarification, I'm not talking about odor once they leave - I'm talking about odor in a multi-plex that infiltrates the hallways, lobby and laundry areas. Years ago, I had a woman who was in love with Lemon Grass oil. (I'm sure she was using it to mask other scents in her apartment.) That smell was making everyone nauseous and without a specific clause in the lease, she just shrugged and considered it no different than Lysol. Now, most recently, it was marijuana odor. My lease prohibits smoking of marijuana, but I believe the storage of it - in large quantities, can also cause quite a nasty odor, too. Tenants look for any loophole to avoid owning their behavior, so the lease has to be VERY clear. I'm not one to fuss about the general smells that come with any multi-plex, i.e., burned cooking, potpourri, etc., but sometimes, someone's go-to air filler is gagging to everyone else!

I guess the closest would be like my noise clause:
Noise, sounds, music, voices, machinery......(odors) may not be audible in the next home (or shared areas and halls).
Strong odors inside the home are not allowed. ?? Maybe define it with "such as marijuana, hemp, fertilizer, extreme perfumes, oils, chemicals..."
Carpet free has made this a non-isue for us.

No shared air ducts means no phone complaints about smells (and partly sounds) coming from the next unit. Exterior entrances means no lobbies for all sorts of problems. No carpets? Sure, put it in there. I think it would be hard to enforce. Threat of eviction is the only power a landlord really has and I don't think a judge will evict for essential oil use, even if it is in the lease.
However, if you emphasize that the clause is in there, it might weed out the stinky people before they rent from you. Also, the majority of tenants will follow the lease if the landlord insists, so a notice to stop the smelly problem might stop some of the tenants from using whatever it is.
Cooking odors cause a lot of complaints and that would be even harder to enforce. You can't stop people from cooking and smelly cooking is often foreign food. You can't discriminate on nationality.

In my condo lease i have such about odor including cooking smells. Make sure if states something about any written neighbor complaints will result in 3 day quit notice posted with a fee of $25 to post notice. An inspection of unit on day four with a fee of $50. (Your lease should include how monies received are applied). 2nd written offense is X($50) fee to post, $100 to inspect. 3rd offenses... after that 30 day notice... just write what the lease clause is and how to handle it and review it at lease signing and have them initial on the lease that there are no smells at move in and they are agreeing to these terms. The landlord is in control, empower yourself with your paper work. Be fair and firm. Someone who doesn't have any intention won't care a bit about initiating this clause. --172.56.xx.xxx |

The 3 day notice is not to move in 3 days but quit the offense of the smell that other residents have complained about in writing, it's not me, i don't live there. 3 days to STOP the smell and clean up. NOT MOVE OUT.

I’m the tenant with a 2 year lease ..the complaint is about me ..my upstairs neighbors 4 blue and purple haired young adults are claiming they can’t breathe because of my smoking on the patio which was agreed to by The leasing agent who is the cousin of the owner he is a licensed realtor which now that they have complaints are denying they gave me permission to smoke in the unit I have it in writing though that he gave me permission and said it was not prohibited now the neighbors are saying I am using strong perfume to mask my smoking which is another lie I have a essential oil diffuser on my patio --104.53.xxx.xx |
