Hey all, I am helping a friend rent out their small 2 bedroom , one bath 800 sq ft house. It has a failed title 5. Mostly likely due to outdated system, not about not working. Can they still legally rent out the house? thanks --96.233.xxx.xxx

Oh! OK. If the septic/cesspool has failed it needs to be fixed so call a septic company and see what they say.

Tank needs pumped? Leach field failed? Bad connections? Got to know what the exact problem is. The septic company should give you a figure to fix it.

If it is the leach field ask back here as there are sometimes different ways to fix that. --66.188.xx.xxx

Bet, Have the problem fixed,and then prorate it on a monthly basis and add it to the rent.Should have been taken care of by the previous tenants who caused problem.thats why rents have to be so high that a d property taxes.Charlie...... ..... .... --174.199.xx.xx

Bet, Title 5 only comes into play when you try to buy/sell the house. A bank will only give out a mortgage if the prop passes Title 5. So, "failed Title 5" = no mortgage = no sale.

But, for a rental, it's not a problem.

Title 5 is more about the design of the system, rather than if it's functioning or not.
