I'm having trouble with OCWEN. They have decided to add fees and other charges to my statement ($2500 and rising). I've always paid on time but they say there was an audit and I was undercharged. I get India when I call them. I think this is because they lost a lawsuit and they think I should help pay. They say they are debt collectors. The county has the mortgage holder as MERS and a mortgage company that seems to be out of business. OCWEN says Deutsche Bank "owns the loan and holds the note." I left a message with them. When I call MERS, I always get a busy signal. I need advice on how to fight this. Who regulates mortgages in Ohio? Anyone been or going through this? White collar criminals. Know a good real estate attorney? Thank you..!! --75.187.xx.xx

Lot of dirty stuff going on with MERS etc.Do a search for Dave Kreiger and the book and blog Clouded Titles.MERS was a way for banks to avoid paying counties transfer fees when they sold mortgages and the banks used it to hide there dirty deals and take advantage of people. --24.25.xxx.xxx

no one at MERS can help you. they are not loan servicers.

ask for a detailed mortgage statement. you should see line by line where the fees come from. If you weren't behind at all, I don't know what kind of fees they could charge you. can you see your account on line and look at the transaction history? --72.95.xx.x

Ocwen is AWFUL. We had been underpaying for two years on an escrow account because of their miscalculations and then they decided to raise the mortgage $100 a month to cover back escrow because of it. I can understand being off for one year- but two??

Check your escrow statements and verify!!

And yes we always get India as well. I have asked to refi these loans and they refuse to even look at the account.

I can't wait to refi away from this disaster.

Ask for the legal Dept at ocwen. Look online for the legal depts at MERS, and Deutsche Bank.

Write letters to each of these departments with a detailed explanation of what has occurred and reference the other companies within. Carbon copy your attorney. If you don't have one, choose a reputable one and simply carbon copy their name at the bottom regardless if you actually use them or not. Send via certified mail, rr requested. DO NOT PAY A PENNY ON ANY of those debts and any checks must be listed in memo as that months mtg payment ONLY. Make copies of them and openly dispute the excess within your letters.

If you have questions as to who is really handling the mortgage, call your insurance company and tax assessor. Somebody is paying them. Make sure those payments are up to date and do the math.

My bets are your payments into escrow were not forwarded from one bank to another during the transfer and I would almost place money that it's Ocwens fault.

Good luck-

I checked the escrow statements and the 1098 end of year and the numbers seem to be in order. This is an 80/20 loan. I just realized that they have also added a $1000 fee to my other mortgage AND they have jacked both payments by a sum total of $350 per month. Unbelievable. It's like they are trying to force me into foreclosure. I read that they make more money that way. --75.187.xx.xx

Is this an ARM loan and your rate adjusted? Even crappy banks can't just randomly decide the nail yku with fees. Either this is a goof on their part or you signed something somewhere agreeing to it. --64.22.xxx.xxx

Was trying to buy an abandoned house secured by an OCWEN loan. It was so screwed up that they don't even have a record of owning the loan. However the taxes still get paid.

This one house was bundled with others through Countrywide, sold to another company that also went out of business, then they sold to another bank that was bought by another, then Deutsche Bank was the executor of a trust that packaged these houses together for OCWEN.

My recommendation is to refinance to another bank and stop the bleed. OCWEN's portfolio is pieced together by bundles, acquisitions, bundles of bundles, etc. It must be bad if they don't even have a record of the loan I was trying to acquire. My guess is that they'll be charging fees when possible to the loans they do have the paperwork for to make up for the mess they don't.

I've never dealt with them as a customer. This is just what I found while researching that particular loan. --108.69.xxx.xxx

Ruh ROh. I have one loan with Ocwen. Now you're gonna make me look.

As to getting India: I thought I read that if you requested it, they had to transfer you to someone in the States. --75.132.xxx.xx

A real Estate attorney seems to be the right chose for a foreclosure defense. I personally believe they don't have the incentive necessary to defend against a Foreclosure. There business is fueled by Real Estate Settlements. If that Attorney does whatever needs to do to defend your rights his income from Real Estate Settlements will diminish considerably. --68.33.xx.xxx
