Tenants are on a voucher program. I sent by certified mail (6/12/2017) a non renewal for them to vacate on 7/31/2017.

Tenants requested a ext (30days) from their program and moved in 3 more Grandchildren (already have custody of 2) into the home without my permission.

I have served (Sheriffs) them and have a court date this month for possession.

This is my question.. How can a voucher program extend a stay without a lease or permission from the landlord? Also, how are they allowed to move in 3 more children without my permission?

Can people go to a court seek custody and now the landlord has 7 people in their home?

Evict as a hold over. They cannot extend the lease without your agreement. Voucher program doesn't care what their clients do so you have to resolve this. I have advice on 2 things for Monday: File eviction papers and don't look directly at the eclipse. --173.19.xx.xxx

Is this the same unit you recently asked about?

Have you actually read your contract with the voucher provider? Most of them require 60 days notice to make any changes including non renewal. It appears as though you gave them at most only 50 days notice.

No voucher program that I am aware of in MA can extend a rental agreement without the permission of the LL. As far as I know only a judge can force a MA LL to allow a tenant to stay past the end of the date specified in the rental agreement.

If the grandparents have legal custody of these 3 kids there is not much you can do about it unless the unit is physically too small for the number of people. How many & what size bedrooms & how many SF is the rest of the unit? If you check the MA State Sanitation Code you can find the SF requirements for the number of people. --72.93.xxx.xxx

Chances are you need to serve duplicate papers to the HUD office, here you can only file the eviction after you have the time stamped rent returned at the office - judge may ask you -how can I evict when the rent is paid?- and you will then realize both tenant and finance staff must have identical documents (and in my area without time stamp you must start all over) costing you at least another month, so you need to know the system and rules to stay in the game. --76.188.xxx.xx

I have evicted a voucher holder in MA. Mine was for non payment and the judge still gave her a 30 day extension but I didn't fight it even though she was not legally entitled to it. I told the judge I would agree to it as long as it was the only one. He said he couldn't promise that. For no cause eviction ( like yours) , especially if the tenant is disabled, elderly or has kids, they can give even longer extensions. The voucher program never did anything to help me, they gave the deadbeat tenant a free lawyer. After the 30 day extension , the judge thanked me for being cooperative and granted a physical eviction. Tenant applied again for an emergency stay ( because she has a baby) and was denied. About 6 months later, same voucher program called me because they thought I was her previous LL ... She is still on the program. Physical eviction and they did not shut her off! --66.189.xx.xxx

That is a nightmare!Housing voucher stated they can only receive one more extension but they will vacate on the 31. I filed anyway.I don't understand how they can add 3more people in my house and not leave after non renewal was given.How is it no cause when they broke their lease by placing more occupants? --98.118.xx.xx

If it says 30 days or nothing, you are good to go - serve them the Summary Process now.

If you terminated their tenancy but did not say why or if you said it was a non renewal, then it is considered no cause on their part. If you said that it was for unauthorized occupants and those occupants are minor children who needed their grandmother to take custody of them then you did not help yourself . I agree with you that she should not have moved people in without your permission. In the eyes of a judge, she is a poor defenseless elderly woman who has taken in her poor defenseless grandchildren. Good that you filed even if they say they will be out.You should probably make her aware that once she goes to Housing Court she will have a housing record that may make it difficult to get a nice place. It sounds like the housing authority extensions are only for the payments, you don't want those to stop. They don't have any authority regarding possession even though they will tell you they do. --66.189.xx.xxx
