I kind of take a different approach, which many folks here don't agree with. When tenants give me the money I give then them the keys. But if they violate their leases they are quickly served with a notice for compliance or possession. I hope they comply, but if they don't, the legal machine grinds into motion. No matter how long it takes or what it costs, it will be resolved.

I let them know that:

- Wilfull damage results in a criminal complaint.

- Anything not covered by their security deposit will be referred to a collection agency.

- Their credit could be torched.

- They will have an eviction on their record.

Fortunately this kind of thing is VERY rare.

Cash for keys will never happen here. Rewarding bad behavior is an abhorrent concept for me. And doing so encourages more of it.

Right and rich are not mutually exclusive.

I use to do just believe like you do. However I've learned that using cash for keys to help get the tenants out & regain possession allows me to get the back on the rent rolls faster. This does not mean that I still don't go after them for any monies owed for unpaid rent, damages, etc. It just means that after I've regain possession, I take them to small claims court to get a money judgement instead of using the court to both get them out & get a money judgement. --72.93.xxx.xxx

Cash for Keys is sometimes the only way to go in a city like Los Angeles where the landlord is guilty and has to prove themselves innocent. For example, a landlord can not evict a tenant (for any reason like non-payment of rent) if the unit is not in good condition. Therefor a tenant who can't pay the rent can simply break a window, put a hole in the wall and pick up a pet rat from the local pet store. Then call Housing and other departments who will write up a report saying the "Landlord" has holes in the walls and has rats on the premises.

Then in eviction court the landlord will loose their case and have to start over after they can prove they paid for pest control services, wall repairs, etc.

I will loose around six months rent, $6000 to $10,000, and have to spend thousands on unnecessary repairs.

All said and done, it is a lot easier to give the tenant $1000 to move out and forgive past due rent.

Jeff,

I understand not wanting to reward bad behavior but it's not my job to train them. My job is to run my business smoothly and profitably.

I'm with Steve. I want them out, sooner than later.

Some courts are very slow (neighboring county can be 90 days), some are expensive (Roy's is $450 to file), surprises happen in court (they declare BK which instantly delays the hearing another 30days or more), people die (had one killed in an auto accident on the way home from eviction, judge gave the family another 2 weeks), defendant can ask for delays (judge gave her an extra 30 days past normal).

I see too many LLs letting pride gt in the way of their business.

All that said, this might help: I add the Cash For Keys to their exit cleaning and repairs costs.

In Michigan, it is required by law that Tenants complete an inventory checklist documenting all damage to a unit upon taking possession. If a Tenant maliciously broke a window to try to avoid eviction, the inventory checklist bearing their signature would prove the damage was caused by them. I also have a clause that states all maintenance requests must be in writing via email for documentation purposes. How can this possibly be happening in California? --50.77.xxx.xxx
