I have a tenant that left a house, owes about 1500. She texted me saying she moved out. I have a old check from her from aug 30 2016. She sent to wrong po box an she sent me a new one, an then got the one from the wrong po box couple weeks later. Can i go to where she banks at an see if i can cash it? I thought there was a service on here where they can cash checks an not get a bounced check fee if is bad. Thanks --70.210.xx.xx

Without knowing anything about MI, I think that I can safely say:

The check was given to you for some specific purpose (such as rent). If so, it cannot be used by you for some other purpose, despite the fact that she owes you money.

I was gonna say if there was rent due, try it at that bank, damages I would send a bill by the amount reduced by using this check if in fact it does go thru - but most checks go sour after 120 days. --76.188.xxx.xx

What does the check say in the memo line? If it says August 2016 rent and you cashed another check with August 2016 rent then that would be fraud. If it says nothing I would try and cash it. There was a thread on here months ago about a someone who refunded a security deposit, reissued the lost check and miraculously one year later the ex tenant found the lost check and the bank cashed it. The impression I took from that thread is that even if the check states void after 90 days, most banks will cash it. --70.210.xx.xxx

Dan,take the cheque to the bank,then go to the next available teller,ask if the cheque is still good,if it is, ask if you can cash it,if they say yes,then do so.Then go home,have another cup of coffee,deduct what you got from the teller,you know the one you just talked to at the bank,deduct that amount from what your former tenant owes you.then file a small claims suit for the balance. I wouldn't try to cash it if it were me. I would take the tenant to small claims and get a judgment for the full amount owed and pursue collections of that amount. The check was given to you presumably for rent for September 2016 and you were paid for September 2016 rent so my thinking is along the lines of Homer's. Whether it would meet the legal definition of fraud, I don't know, but it sure meets my gut check definition. --70.182.xx.xx

I had this happen. Tenants left, and they (mom, pop, adult daughter) owed me X dollars, after I sent them an accounting of damages and subtracted their deposit. Daughter agreed, sent me a check for half and pop was supposed to send check for other half. Her check was written on a small bank local to her, not close to me. Took it to her bank, no good. Told her and she gave me cash. Pop balked at paying anything, but I still had her check. I must have stopped at her bank 20 times over a year and a half. I preserved that check in a manila envelope with a piece of cardboard in it, sitting on top of my sun visor in my truck. Preserved it like a relic. I knew she had direct deposit on her paycheck, and I just had to get lucky and catch the account at the right time, after the auto deposit and before any withdrawals. Finally, one time I presented the check and instead of the teller shaking her head no and sliding it back to me, I saw her hand move towards the money drawer. I danced around the bank like Rocky Balboa with my hands held high. The tenant had been with me a long time and was overall good, so I was kind enough to tell her so that she did not bounce a bunch of other checks. --73.141.xxx.xxx
