State Specific Question About: CALIFORNIA (CA)

A long time tenant since 2012. She is the only person's name on the lease. In the past two yrs, Manager often saw a man in and out of the unit. But, whenever manager verbally asked tenant, she said he was just visiting, then he would disappear for a while.

Recently, Manager saw the the same man around the unit, so we gave a notice to ask for the information and to be added to the lease. Tenant got mad and yelled at the manager. She said , " Why are you giving me a hard time? Is it because my boyfriend is a black?" Manager said, he is an unauthorized occupant, we want to know who he is. The BF later came out and yelled at the manager and said bad words and bad things about other residents. Manager is fear for her own safety, so she walked away.

Manager told me she would not give him the application to fill out, she doesn't want him around the property. She said the man yelled at kids in the property, too. Tenants in the property are mostly Vietnamese and Hispanic. Can I serve a 60 day notice to move out? What if they challenged?

Also, the day before yesterday, handyman went to fix A/C, he complaint the bad smell inside the unit caused him had a headache for the rest of the day. He saw a smoking device with a pipe on the table in the living room.

Bad smell is from smoking. May be marijuana. Handyman doesn't smoke, so he can't stand the strong smell in the room. --172.89.xx.xxx

I would do a wipe test and have a painter prepare an estimate to restore the walls and cieling, is there carpet there that would need cleaning by a truck-pro cleaner? If the amount exceeds the rent split it into 2 payments to be added to the next rent cycle/s, when you allow the tenant (or the guest) to get in control the situation will only get worse. --76.188.xxx.xx

I would give tenant a notice to vacate. Guests are an extension of the tenant and tenants should be responsible for their behavior. I've had two separate tenants move their loser boyfriends into units and I just won't tolerate it anymore. The second tenant is moving this month. If the tenant is MTM, sounds like you can give 60-day notice, unless she is Section 8, in which case getting rid of her would be much tougher. You don't have to give a reason for terminating. I wouldn't say anything about the BF, his race, or the smoking. Just terminate without any detailed explanation. --24.130.xx.xx

I'd count the days that the Unauthorized Occupant is staying there. In my lease anyone staying more than 10 calendar a year no longer considered a "guest" and I'd raise the rent 10% for each additional person.

Your manager is not doing her job. Dealing with uncooperative tenants and unauthorized occupants is Basic 101 type property management stuff. If she is not capable of handing that, you need a new manager.

If it were me, I'd give her 48 hours to resolve this problem. By Monday, it better be fixed, or I fire her, get a new manager, who will evict this uncooperative tenants and/or non-renewal the lease asap.

Seriously, what are you paying her for...to bring you stories of drama like this?!? The whole point of having a PM is she takes care of hassles and mails you a check. --173.19.xx.xxx
