Tenant lease terminated July 31 2017 and we served them a 30 notice to vacate July 31 2017. Basically not renewing the lease. If they have not vacated but Aug 31 2017 we plan on serving them the summary P&C. so is this all legal? --96.233.xxx.xxx |

In NC, the law says:
"A tenancy from year to year may be terminated by a notice to quit given one month or more *before the end of the current* year of the tenancy; a tenancy from month to month by a like notice of seven days; a tenancy from week to week, of two days."
So if I read this correctly, to terminate an annual lease at lease end, I need to notify them 30 days before the end of the lease, or in this case, June 30th to terminate July 31st.
To terminate a month-to-month, 7 days before the end of the current term.

They have a FULL rental period to vacate - ie by midnight on August 31. Serve the Summary Process on September 1 and you are good to go.

Yes it legal. However if their lease expired 07/31/2017 why didn't you serve them before 07/01/2017 saying their rental agreement was not being renewed?

Why wait until August 31?
What about rent for August? They didn't move, did they offer to pay rent?, if so, are you (implicitly) allowing them to remain as tenants? A judge will be curious, too.
You notified them to leave; they didn't leave, but thats OK with you. That constitutes an agreement, as shown by your behavior instead of a signed agreement.

Stop thinking that the security deposit can cover for the last month's rent. In our experience the tenant will leave trash and old furniture/tvs to dispose of, a large water bill to pay, holes and stickers on the walls, filth in the tub, toilets, dirty furnace filters, missing light bulbs and smoke detectors, missing toilet roll holders, filthy stove, fridge and filthy carpet. NOTHING will be left of the security deposit. And to top it all off they will tell the judge when you go to court that it was that way when they moved in. --69.161.xx.xxx |

Unless the paperwork says rent deposit the security can only be used after the unit has been turned over to the manager/owner - time to start eviction about 15 days ago, this manager does not read the local/state tenant rules or does not understand them at great cost to the owner. --76.188.xxx.xx |
