My son moved into an apartment in August. The apartment complex sent a move in money cost sheet with the lease. They paid that amount at move in. They just got a letter stating there was an error and they incorrectly pro-rated the rent based on 30 days not 31, but what they actually did was charge for 1 less day. They are asking for the $97 dollars now. My feeling is that if they put it in writing, they should honor the numbers. I actually find it unprofessional that they would be chasing the kids down for their $97 mistake. I would stand by my numbers since the tenants are already moved in. What would you do as a landlord? What would you advise the kids to do?

If I make a mistake, I own it. But then again, I'm only accountable to myself.
If a complex makes a mistake, I would expect it to be like what a cashier does when a cashier makes a mistake... the difference would come out of the mistake-maker's pocket.
But because I'm softhearted and honest, I want to minimize an individual's suffering for their bad math.
I wouldn't go to the effort of second-guessing their math choices-- but if they say, "Oops," I'll say, "I see."
But it also is a very clear lesson about the management's methods. I'm sure they're quick to say, "Oops" when it means more money coming their way, but I'm curious if they're quite so prompt to correct things when they find a mistake in favor of the tenant. --96.46.xxx.xx |

The letter they sent your son does not make sense. If they prorated by 30 instead of 31, the daily proration goes down, not up -- bigger demoninator. Sounds like they owe your son a refund.
A $97 dollar a day proration for rent equals an apartment rental of $3007/ month ($97 X 31). How nice of an apartment is this place? --98.145.xx.xxx |

Rathdrum Girl - I didn't explain well. They wrote the letter wrong. They actually calculated the pro-rated amount correctly based on 31 days but incorrectly charged for 26 instead of 27 days. The apartment is a 3BR in downtown Denver so although nice on the low end rent wise believe it or not. --24.61.xxx.xx |

Hmm... my guess is that the office guy/gal made a mistake, and either got blasted for it by the boss, or fears that. If it were my kid, I'd say to make things right by paying the amount. Tell him to get a receipt showing specifically what that amount is for.
But I'd also advise my kid to pay attention for any other signs of sloppy/careless management, just in case this is how this outfit rolls - and keep good records in the event that things get uncomfortable.
The upside - if it was a one-time mistake, the office guy/gal will remember your kid in a positive, reasonable light - and will likely respond appropriately to notifications of any issues. --71.175.xxx.xx |

What if the tables were turned and your son discovered they had overcalculated and he'd over paid?
Would he have no right to point it out and ask for a refund?
Should they just say oops, well you paid it so we're not going to refund you?
I'd tell my son to make sure they are correct. If they are, he owes the money. We shouldn't look to benefit from someone else's mistake because we all make them. --173.170.xxx.xxx |

It's such an easy mistake to make if you are counting between dates. So easy to make that there is actually a calculator on line to count between dates for you! And one of the options is to include the end date - because if you don't, it doesn't count it. --173.22.xx.xx |

Sorry your son is going through this. I'd find a way to politely ask them to eat it.
If the mistake was on me, as a LL I would just let it go. It's a good business practice.
However, if they choose to not remove it, no argument then I'd just pay and be done with it. No reason to start off with bad blood.
Id be keeping a close eye on everything this place charges for. How can they make money off of a registration for a utility company? Does your son have the utilities in his name?? --136.32.xxx.xxx |

Some of the utilities are billed through their 3rd party group which you must sign up for with a $10 new account fee and a $4.50 monthly administrative billing fee. It's a racket if you ask me, but the boys went into this with a full understanding. I read their 26 page very landlord friendly lease and gave them a page of notes where I felt they were at risk. --24.61.xxx.xx |

Actually, it's not a racket at all. The 3rd party company is something that is very helpful in a building that doesn't have separate meters for everything. Otherwise the owner just eats all the utility costs and people - especially young people - will run the heat or the AC with the windows and doors wide open.

As with almost all issues we face, what does the lease say? I suspect it gives dates o occupancy and somewhere states August prorated rent. If it gives a total which they paid then the complex should eat it. (likely) If it gives a total per day then your son is responsible for the extra day. (unlikely) If the complex gives you a hard time ask them if they wave late fees if your son forgets to put a stamp on the envelope. --70.210.xx.xxx |
