Hello ,Every one recently i rented to brother and sister both together signed the lease .they both have boyfriend /girlfriend .

i told them no pets at all and on the application they also said no pets .soon after they moved in sister brought 5 pets 4dogs and cats . brother inform me and as it was on the lease they have to give me fine if even temporary you will have pets .

i don't know whatever they had between them brother moved out told me about it and ready to pay lease breaking fees too and sign the paper that he will pay me weekly . but the sister can't afford the place and did not pay me the rent for this month yet.

i already gave them 3 day notice and 7 day unauthoriezd pet removal notice also .

my question is can i just evict only the sister since brother is already gone or i have to evict both brother /sister .

when i gave them 3 day notice to move or pay i had both of their name on the notice .brother did not wanted eviction on his name thats why he signed and notarized the paper that he broke the lease and will pay me lease breaking fees .

this happened to me first time i am confused.i do my own evictions please advise

I'm in Florida and you normally name the tenants who are on the lease when filing for eviction.

So just to cover yourself name them both on the eviction paperwork would be my recommendation. --173.170.xxx.xxx

You'd be crazy not to evict everyone and get them all out and start over with new tenants. Lets say you get one out. Then the next day the evicted party will become a guest of the remaining party. --47.156.xx.xx

Everyone who signed the lease has their name included in all communication/eviction. But, if you already officially removed one from the lease (?), then whoever is your tenant now is who gets evicted. I sense that your agreement with the brother is not clear even to you, so include him too - to be safe. You also need to include "all other occupants" (or whatever is the proper wording there) to be sure boyfriend/girlfriend leaves. I strongly recommend you get a local lawyer who is experienced in evictions to advise you. The cost for an attorney now can save you much more in the long run. --68.105.xxx.xxx

I agree. Just because the brother moved out already and doesn't want an eviction on his name--too bed--YOU do what is best for YOU.

He was party to bringing pets into the unit against the lease, he also brought in a 'significant-other.' He is not innocent. If he really doesn't want the eviction, he should convince the sister to move before the eviction date, maybe even help her to do it.

But YOU shd not allow their drama to prevent you from getting your property back free and clear, and renting to better tenants. BOTH signed the lease, BOTH get named. You need to be rid of both these rule breakers.
