My sister rents a duplex in the next town. Our mother is ill and combined with the negative experiences she has had with her landlord has decided to give the landlord notice that she needs to break 8 months into the lease. She reassures him that she will keep the property show ready and pay until a new tenant is found. Landlord has been in jail for breaking and entering, as well as robbery. He has failed to make repairs neglecting to even repair a large window pane which was smashed by his crew in April, leaving large jagged broken glass pain. Besides being neglectful he is vindictive and manipulative. As has been his pattern when he can't bully his way through something he sends his girlfriend to handle things. Said girlfriend is nasty and my sister has ample text messages to show verbal abuse. Does said girlfriend have the right to access the duplex to show it to tenants? Does it legally have to be landlord himself or can he said any agent? Any recourse for disrepair or harassment? --66.87.xx.xx |

Yes. Do you have photos of this breakage? Just get her out right away and deal with him later. Take many photos so you will have evidence for the lack of habitability in the unit. The window is enough. I would NOT let him know she is leaving. Just sneak her out and then when she is out, let him know. You can then do whatever you feel is fair to help re-rent the unit, keep it clean, whatever but I think one look at the broken window and any lawsuit he might make is not going to fly. I would however, send him a certified letter about the window AFTER YOU GET MOM OUT OF THERE. Then note everything in the letter that he has neglected and any evidence you have. Get a post office box and use that as the mailing address for the certified letter. He sounds too disorganized to find you. Let Mom's security deposit go in favor of saving her further grief staying there. I am asking spirit to help you and you should pray as well. --73.33.xxx.xxx |

Prolly need to have photos of the damages before movein that were not resolved so they don't become your deposit deduction/s then get your moving done and address the actual tenant damages with the agent of the owner, many owners have managers - some with varying angles of competence. --76.188.xxx.xx |

Technically, if landlord wants to do that, he ought to specify in the lease that all rights of landlord may be exercised by landlord or his agent(s).

Regarding failure to make repairs: most likely your state has a legal procedure for what a tenant is allowed to do when repairs are not made. Be sure to learn the process in detail and follow it to the letter before attempting to withhold any rent and/or make any repairs yourself and get the land lord to pay for them. In my town, judges do NOT take kindly to tenants making up rules about withholding rent, and in every court case I have seen where a tenant just did whatever they thought was "fair" the judge ruled against him/her and they were evicted. Evictions go on your permanent background record and NEVER goes away like an unpaid bill on a credit report, so consider carefully before tempting fate. I have denied renter applicants with evictions that were 20 years ago. I simply do not want to mess with someone who does things the wrong way, even if their land lord was a scuzz-bucket. Learn the law; follow the law. Hire an attorney if you are not capable or will to do the research on your own.
Regarding harassment. This is often "he said/she said." I know you have texts, but are those admissible in court as evidence? Your judge may not allow them because digital records can be easily faked by anyone who knows anything about digital photo editing. I am an Info Tech professional, and I have seen people create fake digital conversations. Judges know this is possible. You need to be aware that this media format is NOT sufficient evidence by itself in many court rooms for that very reason. Btw, I DO have ways of proving text conversations are legit as well...so I'm not saying they are useless, but don't believe for a minute they are a magic wand you wave in front of the judge to receive a harassment verdict. Even then, I'll be honest, I have NEVER heard of a judge ruling against a land lord for harassment. Usually, "grow thicker skin" and do not renew your lease when it's up is a better alternative.
There isn't a good way to fix this aside from moving out, I don't think. Suing your land lord won't lead to a happy resolution, even if you win. If I were in your sister's shoes, I'd try to find a legal way to terminate the lease and move elsewhere. --173.19.xx.xxx |

How many times have you heard this same story of the BIG BAD LL as the tenant builds their preceived case againt the LL?
The tenant is described as an angel and LL is--- well everything is bad about him and of course the Nasty girlfriend.

Yes, the landlord can appoint someone else to act on his behalf ...whether he's in jail or sitting at his desk ... he does not physically have to show the unit himself.
