State Specific Question About: CALIFORNIA (CA)

We all know that the legal system steadily leaning against landlords. These days, most eviction cases in Southern California result in settlement with the Tenant, forgiving back-rent, giving another 2 months of rent free accommodation, give resettlement cost to tenant, and finally the tenant wins without even an eviction record.

Small landlords are increasingly choosing the above, rather than close to a year of dragged on eviction case, damaged property, multiple court appearances and jury trials...all because they committed the sin of asking for rent.

Such professional tenants need to be refused accomodation. And the only way that is possible is that we not only get to know about eviction case judgement filed against the tenant, we should also get to know if a eviction was just filed (even if it was settled or withdrawn or won by tenant).

IS anybody aware of such a service for landlords??????

Unfortunately, the state of California decided that evictions should be hidden for 60 days from public record and then only allowed to show if they landlord prevailed in the entire process. --208.74.xxx.x

And whether it was a bill that was passed for this and when..

This is a highly vindictive law that must be challenged..

Big landlords can afford to fight till the very end and absorb the legal costs and months of rent-free stay and damage to property...small landlords cannot.. --216.205.xxx.xx

What eventually happens is the number of rentals goes down along with the secondary rental market vanishes which is single family homes, townhouses and smaller rental buildings. It is not a accident that in the city of Los Angeles has a large homeless problem when the city wants to host the Olympics then the government has to start to build rental units which never works. What needs to happen smaller operators and larger operators need to band together then take legal action which is going force change. As one voice everyone is stronger. When everyone wins everyone benefits. There are landlords associations as one voice start action. --207.164.xxx.xxx

I am a Los Angeles Landlord. Years ago there were around 23 eviction courts for eviction in the L.A. area. Now it's down to only 3 or 4. Presiding over those cases are either a Judge Pro-Tem (Lawyer pretending to be an impartial Judge siding with tenants) or a Commissioner (years working in the courts-learning on the job). If you elect to have a real judge hear you case, then you're dropped to the bottom of the list and maybe your case will be heard at the end of the day, week or month -- if at all.

We landlords are forced to allow tenants a free ride, if they agree to be gone withing 14 to 30 days, we will forgive the past due rent and legal fee's -- often in the thousands. An we as for a Stipulated Judgement -- that if the tenants aren't out, then the court will proceed with a Sheriff's lock out in 10 to 17 days.

I've had the Police enter a home after the "grace period" of the court agreement had expired and provide written testimony that the tenants were still living in the property. Next day back in court the tenant showed up and said, "Oh I needed an extra day". So the Judge gave her another week to move her junk (bottles for deposit).

Life can be unfair. I've leaned only to rent to solid people with a good job and excellent credit. The women above was a Squatter so she broke every rule and the Courts helped her pull a fast one against me... --47.156.xx.xx

I hear you..

Landlords need to unite and fight.. More eviction courts. Make tenant information public, just like any other information. No law should be based on hiding information..

A lot of professional tenants have A grade credit.. One guy with excellent credit wanted to stay at my property, and even revealed that he grows a few marijuana plans at home. Even offered higher rent.

I did some research and figured out what he was up to.. He would turn the entire house into what is called a grower house. He would have altered the electricals of the house (he even admitted that) to power up heat lamps. Add an irrigation (hydroponic) system throughout the house. And by the time I get him to leave, the house would reek off fertilizers, pesticides, fungus, mold and more.. Homes have become tear-downs because of such operations.

Meanwhile every new law seems to be created to protect tenants, and nothing for landlords.. --216.205.xxx.xx

Hi Brad, the Midwest is a great place to be in and definitely not boring :)

I see that you're from Indiana, and I have the following questions for you:

How long can a professional tenant drag an eviction case?? Does it have to go through Jury Trial??

How long does it take to get a trial date??

Do you have enough eviction courts??

Can tenants suddenly bring up habitability issues, and delay cases based on paperwork??

How hard is it to add a lien on such tenants after a case is closed, and judgement is passed?? --216.205.xxx.xx
