State Specific Question About: MASSACHUSETTS (MA)
Tenant was to vacate property on 7/31/2017. I asked for a time of walk through on 7/25/2017 and they have received a 30 day extension (voucher program) until 9/1/2017.
Shouldn't the extension only be to the 31st?

In MA a LL is not required to do a walk thru, why would you request one?
Who granted them a 30 day extension? Any of the voucher program that I know of do not have the power to grant an extension. Only you or the court can grant them an extension.
An extension can whatever the parties involved agree to. It could be hours, days, weeks or even months.
What is the reason for eviction, non payment, violating terms of the rental agreement, hold over or something else?

It's not the 31st yet...you can't evict someone until their lease is up unless they haven't paid rent or there is a lease violation.
If they hold over to August 1st, then follow your state's laws for hold over. In Missouri, I can charge double the regular rent plus evict for hold overs. --173.19.xx.xxx |

You need to clarify whether or not your lease is tied to the town voucher program. For example, in Michigan, if you take Section-8, you often have to add THEIR addendum to the lease -- and it gives them way too much control of when and how you can end the lease. They CAN extend it if they want to in many cases.
You haven't made it clear how that voucher program relates to your lease -- if it does at all. If your lease is a standard lease that ends on July 31st with nothing tied to the voucher program at all (you just happen to get payments from them), then they have no rights to extend it.
But if it IS tied to the program -- if you signed an agreement with them or there is an addendum to the lease -- then they certainly MAY have some right to extend it.
You really need to make it clear what your lease says and if you have any agreement at all with the town voucher program.

Either I'm not understanding what you are saying or you have not fully complied with your rental agreement and / or the contract with the PHA. Why do you think you have to wait until the 7th serve them?
If their present rental agreement ends on 07/31/2017 and it does not automatically extend per a clause in your agreement or in the contract you signed with the local PHA, you could start to evict on 08/01/2017.

The PHA will continue to make payments through a court process so long as they are sent all relevant documents. The PHA does not have the authority to extend, but may be thinking that the Lease is going to auto renew. What area of MA? Certified mail is good, but I prefer Constable service. Did you get the Return of Service for the Notice for both tenant & PHA? Did the signature match the signature on your Lease documents? If they fail to vacate on 7/31/17, you can begin the Summary Process. --73.68.xxx.xx |
