Hi fellow LL,

I have two people living in one of my 2 bedroom apartments. They are boyfriend and girlfriend in their mid twenties. Tenants in other apartments complained that the two always fight very loud every weekend. I gave them a 60 day notice. The girlfriend found a new place and planned to move out on the 25th.

The boyfriend just got out of the prison last year. The girlfriend felt sorry for him and brought him in. He never found a job and physically hit her a few times during the fights. Therefore she is not taking him to her new place. I mentioned to the her that if the boyfriend doesn't vacate the property, she would be still be liable to the rent (only her name was on the lease). Today she called to let me know that she had the police escorted the boyfriend out of the apartment and could meet me on the 26th to return the keys.

The boyfriend is broke and has no place to go (he came from the east coast). I'm afraid that he might come back even after I change the lock on the 26th.

What kind of document should I get from the girlfriend to allow me to just call the police to kick the boyfriend out if he comes back after the 26th? Please share your opinion.

In IL in 1994 the Illinois supreme court upheld what is known as the barring clause. Be sure to include in all your lease agreements going forward.

"Tenant acknowledges that Management has the right to require any of Tenant’s guests to leave the premises or be barred from the premises if these non-resident guests are deemed by the Management to be disruptive in any way or violating any condition of this Agreement."

Tenants must inform their guests of all rules and regulations stipulated by this rental agreement. If rules

Thank you for sharing your thoughts/opinions.

RichE [IL], good to know. Maybe I'll have her sign the paper saying that the boyfriend (aka guest) is no longer allowed to be in apartment anymore. Any attempt to get back inside is considered trespassing.

NE [PA], I don't know if hooking up with someone violates his parole terms (if he's still in the parole period). Fact is, I don't know much about this guy. Only know his first and last name and what he looks like.

Since I plan to rehab this unit, I'm thinking about removing toilet and bathtub on the day that the girlfriend returns possession. It would be difficult for someone to stay there without a bathroom. I'm also thinking about asking the girlfriend to disconnect the electricity. It makes sense for her because she moves out, right? What do you think? --73.22.xxx.xxx

Change the locks as soon as you get the keys turned over. Now he would be breaking and entering. As long as she is the one the lease, she returns the keys and has vacated, call the police if he is there. Because of course the unit is supposed to be empty and you don't want to enter since it seems someone is there and you don't know who it is.

Hooking up with someone isn't violating his parole, although it may in other cases, but if you can persuade his parole officer to believe that he's heading down the wrong path and towards legal troubles, it just might help you get them out. --174.201.x.xx

I'm not understanding the problem. If she retirns possession, you change the locks, and now he can't get in...unless he throws a brick thru the window. If he does that he is breaking and entering. Call cops and have him arrested. His release from jail is probably contingent on him not acting like a fool, so if you see him simply give a friendly reminder that you have his parole officer on speed dial. --208.54.xx.xxx

Ken[NY], good to know.

Sid[MO], some Chicago police are lazy. Last time I called a police on a tenant who was removed by the sheriff from eviction and came back. The police tried to convince me to give the guy another day to move his stuff. That was totally wrong. Luckily the tenant ran away once he saw me calling the police. I brought a few men to haul all his furnitures out.

Danny[OH], I hope that all his belongings are out. He might try to come back to get his belongings.

I'll try to find the phone number of parole officer.

He is a resident now even if he is not on the lease. You will have to evict him if he does not leave. You can try to call the police and tell them he is a trespasser or breaking and entering, and he will say he lives there and then the police will tell you it is a civil matter. Get a copy of the police action where the police escorted him off the property at the request of the tenant. Now you have 2 documents: your lease showing he never had any LEGAL right to be in the unit, was only a guest at the will of the legal occupant. The lease will also show that even HER legal right to the place has ended. And a police report that he was already removed from the property once by fellow officers.

While you are there getting the police report, notify the police that the property is supposed to be vacant except for your workers doing rehab during daylight hours. Request frequent drive-bys, and if any lights on or activity at night, the police shd investigate for squatters. Mention you have been told he is on parole from some conviction back east. If he has been the system the local police can find his case and parole officer. Shd be enough to keep any officer from telling you it's a civil affair. --179.52.xx.xxx

TA [CA], yeah that's what I'm afraid that he might try to pull a fast one. However, he was kicked out by the girlfriend. His residency was ended already.

After the lockout occurs, if someone wants into a rental unit.....they will get in. The best you can do is to limit the desirability of the break in from occurring.
