Tenant is given a 3 day notice to pay or quit,when that time is up you have 2 forms given to the court, a petition to recover possession of real property and a notice of petition which gets a date put on it to tell the tenant when to show up in court,these have to be served to the tenant by a third party giving the tenant between 5-12 days notice of the hearing,you get to court and argue your case,provided you win some courts hand you the warrant right then,some take a few days or a week to get it signed.You then take the warrant to the sheriff who serves the tenant within 20 days giving the tenant another 72 hours minimum,once they serve them they will give you a date and time to meet a deputy to change the locks and remove the tenants stuff,some counties require you to put it in storage,tomorrow afternoon I am doing one where everything goes on the curb --24.25.xxx.xxx |

I hired a lawyer (about 1 month ago) to serve a tenent who hasnt been paying rent for 2 months now and the serve (to pay rent) has yet to be given. What a reasonable wait time btw the time I hire the lawyer to serve and the serve actually happening.
Im running out of patience and the deadbeat tenant is living too comfortably in the apt that hes not paying for.

A lot rental housing providers are reluctant to run credit checks on all adult applicants. Often evictions is a never ending story. Some come around then never return with completely filled out rental applications. Not only is there the arrears of rent they often completely trash out the rental unit. Consider joining a landlords association where Google to find some. Most jurisdictions the vacancy rate is going down where one can fill vacant rental units with people who are going to pay along with taking care of the rental unit. It is better to out of cost of a few photocopies or the cost of running credit checks then go through the eviction process. Problem tenants rental units are a revolving door where over time they can live rent free for a year. It is like a western where head them up at the pass. --158.106.xxx.xxx |

If you hired a lawyer a month ago and the tenant hasn't even been served yet I would find another lawyer,you have to make 3 attempts before it can be attached to the door and mailed,an attorney needs to hire a process server so it may take a few days for the process server to get it and get it served but a month is rediculous --24.25.xxx.xxx |
