State Specific Question About: CALIFORNIA (CA)

The person who drove the van and damage two garages doors and structures is not our tenant.

According to other witness, this person is friend of #G tenant (F#G). He came and had an argument with #E. #E called the police. F#G drove van to get away and hit two garage doors.

Police came. #E was sent to hospital. One person lives in #G was taken away by police. (F#G was caught a few days later, according to other tenants.)

My problem: I was out of town. Police didn't give the manager the case #. Police told manager that we can get the police report anytime just mention the date and location. However, I can't get any report at all because no officer name and case #.

The damage is estimated about $3500. We try to ask #G tenant about the person (F#G), they refused to give us any information. We bill tenant, of course, they refused to pay. Our lease said "whenever property damage ... on the part of the Resident or visitors, the Resident agrees to pay the cost of all repairs."

Any other suggestions to get tenant to pay?

Request all incidents on that hundred block of that street for the time period in question. Use FOI (Freedom of Information Act) if you need to. Our PD has a web site where you can see incident and general locations. Maybe something like that can help. There is no reason you can not get the reports. They are public records. --108.196.x.xx

AW,

You can probably get the police report by using the address and name of your resident.

"Refuse to pay"?? We add it to their ledger sheet. Unpaid balance is considered rent and grounds for eviction.

"Refuse to give the name of the offender"??? Are you certain your res did not do it?

THIS is why they have car insurance and renter's insurance.

(I realize none of this common sense advice might not apply to California!)
