A Tenant moved in and immediately began smoking pot in her bedroom with other people, with their 5 year old daughter in the room as well. She lied when was confronted and said that she could smoke it wherever she wanted on the property if she wanted to because she had a prescription. True or not true? When room was rented to this person, her condition was never disclosed. The move-in contract and roommate agreement stated "drug free home."
Can she be kicked out? And how fast?

I am sure they can smoke it, be sure to do wipe tests and get estimates for seal/prime/refinish soon so they can make payments over a 2-3 month period to resolve the effects of smoking at a smoke free place. --76.188.xxx.xx |

I was able to evict a pot smoking tenant about 7 years ago because the smoke went into other units and there were kids living there. And when the tenant went outside to smoke, they did so with friends under other tenants windows, drank beer and make noise after 10 pm. --47.156.xx.xxx |

Best solution is to inspect and bill for smoke remediation now. Plan on $300 per room to clean, seal, and repaint. If carpet, add cost to replace carpet and pad. Send it as a bill mow. --66.87.xxx.xx |

What does your lease say?
My lease is long because it covers issues like this, so I don't have to dream up a solution.
It includes smoking of any kind: including e cigs, vaping, and any form of MJ.
If you did not set this forth at the beginning I'm not seeing a way out now. Not sure if Wacki-Cali considers this a drug.
You said "room"". Is this a roommate or rooming house? Might fall inder disturbing the other occupants.
Daughter: that's her choice and has nothing to do with you.

The problem here may be that its considered her medication. This may be the new therapy pet hitch for LL's. ,
Interesting as there are energing different forms of MJ availabe w/o smoking. Althought I can see tennies that whine to a Dr ,.."but Doc,.. only the smoke form works for me,...can I have a statement that says I HAVE to be able to smoke it"
