What criteria can you put in for not accepting qualified applicant based on Lack of Trust and not discriminating? I had an applicant and sent them acceptance from an out of State renter but the property was seen by their representative as one of my criteria. I indicated that acceptance is within 24 hours to sign the lease and send the funds via bank account deposit. We’ve been communicating many times through phone beforehand in such a bad tone of arguing many things to pay the deposit. He wanted to mail personal check but refused to accept and doesn’t want to put funds on the account based on my deadline. I sent the lease via e-mail and he was able to sign it but I haven’t sign my part yet and now delaying the funds to be sent. Indicated on my lease paperwork that this is null and void if not followed in accordance of lease signing return and proof of funds deposited to the bank. The time lapsed and he wanted now to deposit the funds but I no longer trust them as they’ve been lying too many things. Thanks so much in advance for all your inputs. --24.17.x.xxx |

In 2010 HUD, wrote, to clarify the process, in part:
'Although we recommend that landlords accept the first qualified applicant', ‘fair housing law does not define qualified and does not require the landlord accept the first person.’
'Landlords are allowed to adopt whatever method (criteria) of picking a qualified applicant.'.... (as long as it is not discriminatory and it is used for all.
'Landlords have the liberty of accepting applications' and 'screening through them for the one they choose’ (under these guidelines).
Discrimination:
Is not found automatically when one person is treated differently from others.
Discrimination is found or arises only when one person is treated differently from others because of that person's ‘membership’ in a protected category, that is, because of their race, gender, religion, etc.

I think I would send them a certified letter via snail mail, with green return receipt, that the lease they signed is canceled as they did not meet the criteria for payment, etc., according to your requirements. (You could copy this in an e-mail to them also.)
I don't think this has anything to do with discrimination, but is simply a non-compliance issue. You definitely don't want a tenant like that.
I also would never rent to someone I haven't met in person to avoid any scams. Even meeting an applicant in person requires caution - such as a young mom renting and taking possession, but only as a front for others to move in and turn your rental into a crack house, for example. This kind of thing may be rare, but it does happen.
I don't know how this person would go about depositing funds to your account anyway, but you could talk to your bank about maybe blocking that possibility? If you end up having to return any funds, it would probably be best to do that with a cashier's check and certified letter via snail mail, with green return receipt. This could help to protect you in case this person causes any more trouble. --71.246.xxx.xx |

My written list of criteria to approve a renter includes cooperation and respect. I see both of those lacking in this applicant.
By your account, they are:
1) argumentative
2) slow poky
3) refuses to pay in certified funds
You can deny them for any one of those. No worries about discrimination. None of those are protected classes under Federal Fair Housing. You are not obligated to tell them why they are denied unless it is due to an adverse credit report reference.
I would block their calls/texts/emails and go find someone who will be a good tenant. --173.19.xx.xxx |

Certified funds only, this is a classic outa state problem, need to understand the terms of the agreement while viewing the house, if I remember he had an -agent- who will likely lose his earnest money for backing away based on misunderstanding the agreement, did the -agent- sign a holding fee agreement or did you waste hours - days and weeks learning this lesson. Hopefully you will now print your state and local tenant rules read them backwards then forwards - oops forgot to mention place them into a 3ring binder and flip over for the local rules so you don't get them mixed up, you will find some overlap of the rules but you need to visit housing court to learn what overlap is ignored, spending about 6-10 months at a local investor group will help you out before you attempt to open for business. --76.188.xxx.xx |

We recently had a twin to your applicant!
Congrats on following advice offered.
Be VERY careful what you say at this point. My email to the twin was "Management has not accepted the lease. Please find housing elsewhere."
He called IMMEDIATELY about 8 times, emailed 4 times, left messages about "his lawyer blah blah...". We simply did not answer because there is nothing to talk about.
LLs are often sued on what they SAID or TYPED.
He was probably playing another LL, juggling houses and deals, then settled on yours.
Market like a crazy person and get this home filled. The ARE decent, stable renters out there!

Just remembered...
The twin rented a similar house in the same neighborhood from a friend a week later. Acted promptly as instructed. So yes, he does know how to act, proving to me that something was going on behind the scenes.
We found a great resident - a single lady who travels, seldom home, and her aged Mom who travels with her.
