I have tenant that is going from a one year lease to month to month agreement (the initial lease states that it turns into a M2M after the first year). Their lease ends July 31 and I am changing the late fee policy. I am sending them a letter letting them know of the change in late fee policy. Do they need to sign and acknowledge that? Or can I simply say that it is in place as of the end of their lease on July 31st?

In my state I would just need to send a "Change in Terms of Tenancy" notice with 15 days' notice. The notice would provide detail on the new policy. I would send this regular mail. It would take effect after the tenant was on a month to month rental agreement, but I could time it to take effect August 1. Tenant would not have to sign. --98.145.xx.xxx

Amy,

Technically, if you change the LEASE TERMS you must have them sign a new lease AND Lead Acknowledgement, and provide new Lead pamphlet.

I never understand why LLs want to take a person who was willing to make a year commitment and eliminate that commitment.

I also make THOUSAND$$$ each year with Early Buy Out Fees because my lease renews automatically (with a 2.9% Cost Of Living increase = MORE income without stressing).

I find Tenants are generally unwilling to sign acknowledging changes. Send a notice of change, if they continue paying rent any judge will consider that they've accepted the new terms. --96.236.xxx.xxx

No they do not have to sign anything. 30 days notice is from you. Either party can give notice to move. They can accept these new terms or move by sending you a notice in the mail that they are not accepting this and will be moving. They do not have to sign or reply, by staying and paying they agree. --66.87.xx.xxx
