State Specific Question About: ILLINOIS (IL)

We moved to Indiana in January for work reasons. Our house did not sell so we rented to a neighbor who appeared to be in good standing in the neighborhood.

I never intended to rent, as I thought the house would sell. That being said, I am in a bad situation.

The new tennant has been late on every rent payment: a few days to a week. since February, 2 of the rent checks have bounced, the most recent today.

At this point, I just want him out, and put the house on the selling market again. He is a police chief for a local town, so I am sure that he has seen this happen on some level.

What should I expect (expecting the worst case, since I am sure he likes our nice house) to happen throughout the process?

I know that everything that lead up to this was a big mistake, and I should have never done this. I understand that this is my own fault for trusting. --74.142.xxx.x

I would always recommend a landlord green to evictions handle it through an attorney. I would especially recommend this since you aren't even in the same town anymore. Many of the bigger towns have attorneys that do this on a flat fee basis, mine does. It's not worth it to me to having something messed up and have to start over. It'll cost you some money and whatever time your state requires, but it'll be worth it. Sorry you have to mess with this. --98.175.xxx.xxx

Sorry for your trouble. I had a Sheriff once who was rude and threatening to me. He left owing me money. If you do not know how to evict I recommend that you call around and hire an attorney. If you try and it doesn't go through you have to start over and lose more money. If he didn.t pay you for the bounced checks take them to the DA. Where I live a bounced check is serious and the DA gets your money. --72.174.xxx.xxx

Your state probably considers the payment of rent and his occupancy as a "verbal" lease. State laws are in place to protect you and him without a lease.

Brad's advice is good. Give this guy 3 days to get out, no fuss, no foul. After that, lawyer up and GAME ON!

I use a local, experienced, landlord/tenant attorney for my evictions. He has someone from his office in court 4 days a week doing evictions: they are a well-oiled machine. The cost is only $268 for a single tenant, and about half of that is court costs and the process server I'd have to pay for anyway. --173.19.xx.xxx
