State Specific Question About: IDAHO (ID)

We have nightmare tenants and our attorney went to eviction court recently for nonpayment of rent. The tenants were not around for the start of the hearing so the judge ruled in our favor. After the attorney left with the judgement paperwork, the tenants showed up late and pleaded with the court clerk to ask the judge to re-schedule because they said they could not find the correct court room. The judge agreed to this! Now we go back to court again next week. I don't get it. None of this makes sense. In your opinion, why would a judge do this? They (tenants) haven't paid and they did not show up at the right time for the hearing. ??? --108.184.xxx.xxx

Some jurisdictions there government funded tenancy advocate groups which tell tenants how to play the no rent game. If they work then after the eviction enforce the judgement for garnishee of wages. --74.220.xxx.xxx

We have had this happen. Lesson learned for court around here---don't leave right away just in case they show up late. This doesn't seem right, but I'm not the judge. Also doesn't seem right when the judge comes out of his/her chamber 15-20 minutes late. --24.233.xxx.xx

You may be surprised to understand that the judge may be interested in giving a fair hearing on the actual issues of the case. Some judges are funny like that.

The actual case in your instance is your claim that the tenants haven't paid rent as they are supposed to, and that under the law, they are obligated to leave, and if they don't, then the court should put them out. All of that may be true, but in a democracy, defendants get a fair hearing to determine the facts and how the law should be administered.

The tenants did not get their fair hearing, and that is what the court case is all about. The judge is less concerned with the details of who is on time, who wears a tie, and who is mildly inconvenienced by the details of making the court system work in the way that it is supposed to.

Good for your judge. Thats what he was hired to do, and he seems to be doing his job.

What Moshe said.

Our judge would do that. He lets everyone have their time in court.

On the flip side when this happens to us (wrote down the wrong time) he allows a new hearing.

Next time, if possible, ask to be heard time THAT DAY, "so the res does not lose another day of work".

Also remember Small Claims is more casual to allow the common person to represent themselves.

He also starts every hearing 10 minutes late to avoid exactly the issue you had - lost people, clogged parking, wheelchairs, etc.

Just so you know you are not alone: got a call today from the courthouse that our evictee who is supposed to be out Monday at noon was given another week by the judge "because she asked".

I learned early on the court is not there to fix my problems or collect my money. It is there is solve disputes without a duel on Main Street and help keep the peace between citizens. No one is truly happy after court. Each party is slightly disgruntled.

AND judges are elected so he wants to be seen as fair to everyone.

Thanks for the responses. I have to use attorneys to get this done so this is an expensive situation for us that will now double or triple in cost. In addition to not paying rent, these crazy tenants are trying to ruin our property. Neighbors describe them as evil. It is a little hard to think about what is fair for them at thus time but live and learn. Interesting to know that this does happen to other landlords with regard to judges and court. --108.184.xxx.xxx

I would file for an emegemcy eviction if I have proof they are a threat to the property.
