State Specific Question About: CALIFORNIA (CA)

I have a tenant for 3 years at a SFH in a good neighborhood. Generally good tenants paying on time.

Lease is now month-to-month and last increase was Jan 2016. Rents are quite a bit higher now and so i have notified the tenant that rent will increase starting July, Left multiple emails, texts, voicemails etc. to get them to sign lease addendum, but tenant seems to be avoiding me. Any suggestions? --24.6.xxx.xxx

Since they are MTM, assuming they are not rent controlled, just mail them a rent increase letter with 30 days notice. That's it, no need for an addendum. --47.156.xx.xxx

To follow up with what Coplin said, I also mail certified mail, and I take a picture of the letter prior to putting it into the already addressed and posted envelop so that I have evidence the letter was sent AND what the contents of the letter were.

I also use Google voice and text them the date and amount the increase is effective and I take a screen print of their name, number, date, and time the text was sent.

I also send via email to the address listed on their rental application, saving a copy to my online drive.

I also call them and record either our conversation and/or the voice mail I leave them....another handy feature of Google voice (Missouri is a one-party state, so I don't have to tell them they are being recorded...check your laws if you want to try this).

So if tenant ever says, "I never got that!" I have four exhibits to enter into evidence in court. To date, I have never had to bother going to court over a rent increase. --173.19.xx.xxx

You are in the City of Santa Monica, nothing to do with Santa Claws! You can not hope or wish your tenants will sign a lease -- that has expired! You should have requested them to sign a new lease a month before the current lease expires. Then if they refuse to sign, you could have asked them to leave because the lease is over and they refused to sign a new one. Case Close.

But in Santa Monica, West Hollywood and Los Angeles, once a lease expires it becomes a month-to-month tenancy and tenants Do NOT have to sign a new lease, once expired.

So was the case the last time I checked regulations.....check with an eviction attorney. --47.156.xx.xxx

Check your lease and local laws, but I don't have to get them to sign anything. We email a notice of the new rent and they can reply to discuss it or give notice they are moving. If there is no reply, the rent goes up. If they don't pay the rent, they get an eviction notice. --73.102.xxx.xx
