State Specific Question About: ILLINOIS (IL)

Have a Tenant, said they'd be out a week ago. Moved pretty much everything except for 3-4 dining room chairs and a box or randoms. Told me 4 days ago are waiting until Wednesday for something in the mail.

Told them to put vacancy notice and keys in drop-box or returned to office.

Question is...if nothing is returned should I still file for eviction?

Have they paid rent?

With them that close to finished moving, I would contact them and let them know they need to move the last few things and return the keys or you have to file. --73.102.xxx.xx

confusing post. if rent hasn't been paid you should have filed right away (what are you waiting on KEYS)? You can always remove it but at least it's in the works.

There appears to be many who hold off filing with the court for non-pay of rent. Don't understand that because it is part of ownership.

We have found filing on line speeds up the process by 3 or 5 days. --74.184.xxx.xx

If they're waiting for something to come in the mail, inform them that they can have their mail forwarded by going online to USPS.

They owe for this month plus late fees.

I have informed them of options to complete a change of address. Main item left over is a inoperable vehicle in unit parking spot and other few items previously mentioned.

Have the 3 days ready to file on. Had my hopes in one jar trying to save court costs.

Filing on 3 days and taking the lost. At least the unit is decently cleaned and left.

Lisa this is meant constructively.

by not filing right away you increase your losses many times over. A jar to save wishes--- no a court to file with ASAP and I do mean right away.

Not just in this case either. Policy of no rent or we file on 3rd is very easy to follow and most cases tenant is going to pay-- and that includes cost of court. --74.184.xxx.xx

Thanks. Do appreciate all advice. Thankfully tenant has returned everything with notice. But definitely following protocol next time over the stress on waiting. Again, thanks much everyone! --173.29.xx.xxx

Lisa, also it is a five day pay or quit in Illinois, not three. So I'm not sure where you're getting the three days from. --75.132.xxx.xx

Quad city area. Majority properties in Davenport side. Haven't had to do anything quite yet on the IL side as far as legal. --173.29.xx.xxx

Absolutely! They haven't vacated or returned the keys yet. Get a judgment and then collect on that.
