I have a tenant who's bi-polar who gets a subsidy from a non profit who assist these kinds of folks. I took him on in November to fill a vacancy with the suspicion I might have to can him later so I put him on a month to month. Everything went well until the last couple of months. The agency pays 70% of his rent and that part is fine, however, over the last couple of months there have been problems with his part. Last month he claims his son stole his ID, opened a bank account in his name and diverted his SSI. I went along with that until he got a replacement check from them and paid. I waived the late fees as a courtesy thinking it was legit. This month, he's claiming that someone stole his money again (obviously the incident last month was a lie as well) and he went to another agency that provides emergency funds to prevent eviction. I gave them the number to clean it up, but haven't gotten the check yet and Wednesday morning is the court date. I've been thinking that the agency is on to the scam and have decided not to pay. I'm also thinking that even if they do, I ought to refuse the check and proceed with the eviction. I'm having an issue with this person's integrity and I'm thinking he's reached the end of his shelf life and I might as well can him now as I can get a new person in there now. Advice for me?

GKARL, is this in the room house or another property? What you're doing is making a business decision. So looking at the facts to me it makes good sense to follow through. It doesn't mean you're hartless. If this is the first time you're dealing with someone who's bi-polar you may be finding it more of a challenge because you don't have prior experience and you're tryingoing to do the right thing. This is for another property. Actually, this property would be a great one to turn into a rooming house.

He is going to make your life miserable. The longer you wait the more stress you will suffer and the more money you will loose.

go to your hearing and get your judgment. take the housing check since that's for back monies. June rent will be due by the time his next check comes ... which coincidentally will be the date to file for possession if something happens to June's rent !! that is going to be a "grey" area but you have nothing to lose.

I've found that most agencies that pay are slow. Most don't just give you a number ... you sign a contract (often times with you agreeing to stop the eviction process), give them a W-9, etc. I'm waiting on a check now and I talk to the girl every 2 days ... I don't want to slip through the cracks.

To o p e n a bank account, then cash a check? I'd want him to press charges. But we know that both cases were likely fabrications.
