I have been thinking of putting my rentals in a trust, that are currently in my personal name. My question is if I put in a trust can I represent the trust for evictions or would I need a lawyer? I have been looking all over michigan law an can't find anything. I know of I put in llc I need a a lawyer --70.210.xx.xx

we have seen many times here that when you get an LLC that you need an attorney to do court work. That is not true in our state. Our manager brings a letter from the LLC authorizing him to perform as the representative of the LLC. Every judge who has questioned it when seeing the letter has allowed it. --74.184.xxx.xx

Michigan is pretty specific and says that you can't represent an LLC. You can a partnership, but not really any other legal entities.

I could not find anything on a trust though. Sorry, Pam. Do let us know what you find!

Just to add to that... Michigan also states that you CANNOT use a lawyer for small claims court -- you can only represent yourself.

I always find LLCs interesting in Michigan since, technically, the law says that LLCs can't do anything in Small Claims - since you can't represent your LLC and you can't have a lawyer there either.

With Michigan's landlord/tenant laws the way they are -- if someone disagrees with your S/D deduction, then your only option is to sue them. Since an LLC can't do it in Small Claims, they would have to do it in District Court -- which can get pretty expensive because you'll want a lawyer there!

Because of that, I think people using LLCs in Michigan for landlording are a bit crazy. (I know some judges seem to ignore the law and allow them to self-represent -- but if people started pushing this, it would be trouble fast.)

This was interesting reading.

I thought from the title that we were going to speak about a person's integrity shows not through speech but rather through their actions.

Over the last two years I've had countless people tell me they will this and they will that and that I need not worry. It is as if they are speaking in an "opposite" language. To a person they have failed to keep their word.

I thought this post would have an interesting way to spot a person with good character.

In my state an LLC needs an attorney so I would assume a trust would also but some courts don't require it but what I do is bring the eviction in my personal name,a tenant would need to know this and know who the deeded owner is to say something to the judge.I and several friends have not been caught yet,if I do get caught just start over with an attorney. --24.25.xxx.xxx

I believe you would be fine in a Living Trust as you retain full control as the trustee. An Irrevocable Trust is another animal as you give up all control. --73.181.xxx.xx
