I have many policies with Foremost. I intended to pay for property/policy A but put policy # B on the memo line. Foremost applied the payment to Policy B and sent me back $64 since it was less than policy A. Policy B was not due yet. Policy B is in my husband's name. The check was written on my account (different name). This was in Jan. In May, we had our 2nd hail storm and I have roof damage on property/policy A. I called to report a loss and was told that Policy A had expired.non receipt of premium. Since I knew I paid the premium, I pushed back. They finally realized that they applied my payment to Policy B due to my error described above. Now, they will only renew policy A if I sign a no loss statement which in essence, prohibits me from having coverage for the existing hail damage. The agent is saying she wished I had never told Foremost that I had hail damage;
they would have corrected the error and I would have been good. Now, no one is calling me back. I get that I erred in making the payment but my position is that the money was paid timely and their accounting shows it was. Do they have the right to maintain the "lapse" in payment and not "renew" the policy until I sign a "no loss" statement. If not, what is my recourse?

It is not there fault,as far as they are concerned you paid for B and let A lapse which is what you did.I don't think you have any recourse --24.25.xxx.xxx |

you were human and messed up. you had from January until May to figure that out. they have no way of guessing what you actually wanted to do. they don't guess what happens with different checking accounts and policies. They don't guess at anything.
You sent a check and indicated it was for a certain policy. they did what you asked and applied it to that policy.
Didn't you receive a notice of cancellation? didn't the refund check make you double check?

If you have a loan on the property, there is possibly lender placed insurance, which you could claim it under.
Did you write the correct policy number on the check that was misapplied? I had chase misapply a payment. It took me 20-24 hours of time on the phone before they could completely correct it. At the end I asked for a gift card and they essentially laughed at me.
Your best best absent other progress is to run it through the state regulatory body that oversees insurance. Ins cos don't like this move and may take care of you once you begin the process. Good luck.

I think a lot depends on when the check came from the insurance as a overpayment, this would indicate when they announced the payment made to the wrong one. And you then should have made the correction/s. --76.188.xxx.xx |

I made the payment online via bill pay. I used the Foremost acct I had on record which I learned was for policy A, the last one I paid. Instead of changing the account # on bill pay, I wrote the account # for policy B on the memo line. I since learned that unlike a regular check, Foremost didn't get a virtual check so they didn't see the memo line and applied the payment to policy A. I get refund checks all the time from insurance companies. I didn't think it was a cause for alarm. In fact, had I not had hail damage, I would not have been the wiser. Policy B is not even due yet. I was told it's up for renewal and a statement was just mailed. They expire months apart. Furthermore, they are willing to reinstate the policy if I sign a no loss clause. I will call the agent again tomorrow. If no satisfactory response, I will write to the insurance commissioner. Thanks all --108.64.xxx.xx |
