I have a management company for a single family house. The tenant email about a dead tree limb, at the end of the driveway. The management company informed me. I said, "If the maintenance guy can't cut the branch, send me pictures." Well, I never got any pictures so assumed that it was cut.

Fast forward 8 months, the tenant calls saying her car has been totaled and wants someone to pay. The car is only worth 1,200, and that's what she is requesting.

The management company doesn't return my emails. I'm

requesting partial payment of 50/50. Is that fair?

Who is responsible?

I say all three of you equally. Tenant knew and parked there anyway. Management company failed to follow through with your instructions. You failed to follow up on your instructions. Thanks for all the responses everyone!

Nicole, the maintenance guy went out to fix the garbage disposal and also cut the dead tree limb if possible, if not, take pictures. I never received any pictures so assumed it had been cut.

JohnnyB, The limb fall on the car that was parked at the end of the driveway. Hope that clears that up.

PattyK, Tenant notified the management company 8 months prior to the limb falling on the car.

I called the insurance company and they only cover the house, not the tenant's car, especially when management was notified of the dead limb. I also thought that my insurance would cover this since also having umbrella insurance along with regular insurance coverage.

Jill,

Not your problem.

The res is responsible for her car and having it insured.

She must settle with her ins co.

In real life I suspect she does not have comprehensive ins on a $1200 car to cover damage.

People tend to exaggerate auch issues. How big was this limb to total a car?? Have you seen the car? The limb?

Tell the PM to pay her out of their pocket or fave a lawsuit from the res or from you for lack of performance. Be aggressiveky proactive on this before the res includes you in a lawsuit.

This is my pet peeve - people who do not follow through, and thereby force me to keep tabs on stuff for which I pay THEM to supervise. When a law firm in FL was supposed to stay on top of the probating of my dad's will, I had to frequently call to prod them on or notify them that a step had been missed. I couldn't fire them, because they had a good relationship with a difficult judge who would put unfamiliar lawyer's stuff to the bottom of the heap.

I'd put it onto the management company. Tenant notified, you directed, they dropped the ball.

Doesn't the management company send out itemized invoices of what was done? If not, I'd definitely get a new one. If so, it's up to you to stay on them about it.

See if tenant can run it through their insurance as comprehensive. Pay their deductible. If not, you will probably be on the hook for the full amount. I'd ask management to pay it. And then get a new one. They probably have too many for you to get the attention you are paying for.

Also, I'd be checking with an insurance agent to make sure this type of damage is consistent with a branch falling on it. --136.32.xxx.xxx

when you received the invoice that stated:

fix garbage disposal $50.00

why weren't you looking for:

tree limb removal $75

In the future, why not ask for photos of completed work rather than undone work? I am not a long distance landlord but you will need to ask, get a response/acknowledgement and then YOU again follow up. --72.95.xx.xx

cjo'h, I'm and out-of-state owner/investor with 2 single family houses. I would manage on my own if not for the turnovers. Garbage disposal is on my to-do list to take out.

Andrew, There is written proof, in the form of email, that I asked to have the limb cut.

Brad, There are several pictures of the car and the limb. $1200 doesn't go far. It smashed the roof and broke the windows.

I loathe mgt cos. They're the financial advisors of the real estate world, they make money whether you do or do not, regardless of their incompetence. 99% of them are awful - I say this from my own experience.

I would pin this on the mgt co, if they can't provide proof this issue was addressed - that's what you pay them for. I'd consider filing a complaint with the re commission. The least they can do is give you a response. Time for a new mgt co... great ones are a lot like bigfoot.. rarely seen! --70.195.xx.xx

This is my take on the situation. the tenant is NOT at fault. They notified, nothing happened. You are responsible to the tenant for the damage. The mgmt. company is responsible to you for not doing as instructed.

I bought a Porsche Boxster "S" a few weeks ago which had been an insurance write-off (during a safety brake test, the engineer floored it while not being on those rollers. Driving the car into the wall).

So what's bad? Got a photo-link? Often, one can replace the hopod and a door cheaply. and a dented roof can be mended, too. Doubt the car won't be d r i v e a b l e.

But tenants rejoice when they feel they have a claim. (I had a woman complain about the cleaners after move in. I okayed her buying materials. She returned with xx bottles @ > $ 55!) If the car can be repaired, $ 200 might do it. So what if it looks ugly and the new door is the wrong color --46.5.xx.xx

As a long distance owner working with a mgt co, I disagree with some sentiments that the owner has a duty to babysit and verify all work is completed in a timely and proper manner. No matter what, I think the Property Manager is liable. They were notified by you and tenant, and did nothing. Therefore they did not manage the property. Had they done their job, it wouldn't have happened.

Futhermore, if you have a PM, why are you even involved? What do they do to earn their money if you're called for everything?
