If you have a tenant who doesn't move out and stays beyond their lease, the SD return clock doesn't start until they actually move out right?

but what if you have a couple and one person moves out and doesn't sign any renewal. The other person stays after lease expires, but no renewal occurs since I didn't get both people to sign renewal. The person that moved out can't demand the SD or can they? --12.156.xxx.xx

What does your lease say?

According to my lease, the SD is not returned until the unit is completely cleaned out and all belongings are gone, and they return the keys.

If the SD was given in support of a joint tenancy, then return of the SD is done in support of the joint return of possession. So the clock starts when landlord gets possession returned.

In most if not all states, you may deduct from SD for unpaid rent. While there is an issue of how much daily rent may be charged for a holdover tenant, you will probably not get into trouble by deducting daily rent calculated as the monthly rent under the expired lease divided by 30.

In MO, I'm not obliged to do anything regarding the security deposit until the tenancy terminates. All jointly and severally liable parties are required to fulfill all conditions of the rental agreement, which at this point has converted from "at will" (lease) to "at sufferance." Doesn't matter one of them moved out. Clock starts ticking when the tenancy ends. Today, it continues. --173.19.xx.xxx
