Just saw this in the local news. College says no to service dog in training in dorm rooms.

Well it was not a dog for her disability so until it is for a student with a demonstrated need it' just a animal...

Legally, a SDIT is not a trained SD. So no issue there.

I am very much appreciative that OPM brought this issue up. I am now in the process of updating my lease riders, and I am currently working on a new lease clause which addresses the subject of service dogs and Emotional Support Animals. Hence, the sentence "A service dog in training is legally not a service animal" shall now be incorporated into that particular rider clause. --66.87.xx.xxx

I agree with Vee. I would NOT add that to my lease. Because it is already the law. And, should that law change, I'd rather my lease not be in conflict with it.

If you have a "handbook" that goes along with your lease -- you might have a section that makes it clear to people that the law does not consider SDIT to be SDs. But I would not add something like "A service dog in training is legally not a service animal" to an actual clause in my lease. I don't need to re-state federal law in my lease.

Vee, no I don't presently have a handbook. I do agree that it is a good idea, especially when dealing with a bunch of operating rules and regulations. I also wasn't aware of the federal guidelines on service dogs. At the moment, I had been incorporating these in my lease riders. I'm all for this format if it helps to streamline my lease documents.

There are federal laws (the FHAA) concerning both Service Animals and Emotional Support Animals. I would definitely read up on them -- we, as landlords, need to know how they work. Especially before you add anything to your lease concerning animals. People worry me a little bit when they say that they aren't aware of federal laws on Service Dogs while writing Service Dog related clauses into their leases! :)
