Survey Question:
This year I had a "slip and fall" at my apartments. I have a company that comes and plows our parking lots, the house rules state that each resident is to shovel their front and back sidewalk areas and that if you live in a end unit you also must shovel the sidewalk on the end of your apartment (fourplex style apartments 15 buildings).
My question is: how many of your provide complete snow removal of your properties each and every snow storm ?
My insurance company is suggesting that I should be providing that service. However, how could I possibility be there every storm and every time of day to complete this.
What are your thoughts ?

If you already have someone plow the lot, I would ask them to do the walks as well. On campus, they actually use the small plow on the sidewalks.
Also, the company should be salting the walks.
That said, discuss with your lawyer about wording you can put in your lease regarding it. Mine states that I'm not responsible unless I'm negligent. Winter happens and brings snow and ice. No one can be there and remove all the snow and ice. It is expected by a reasonable person that if it is/has been snowing, there will be snow and ice and that one should be careful when walking on the sidewalk. --131.151.xx.xx |

My tenants all like to shovel a bit and it's hard to make them wait for the snow guy. I used to shovel everything and clean everything myself with equipment stored at the buildings.
This year we had an odd snow that came late and very wet then froze overnight. Suddenly some of the gung ho tenants wanted instant fix. One of my providers didn't do a good job at one place and didn't show up at the other so he is fired.
I have a new company and they got to me fast and did a good job so next year and the next five years I will be in good shape.
The next five years will be very cold and snowy. The sunspot cycle is at a time when the sunspots are low in number. That means that the air envelope is not being heated and expanding but is cooling and shrinking. We also have a lot more ultraviolet rays coming in so protect your eyes. In addition without the sunspots, we are getting more gamma rays and other space related rays and that can cause heart arrhythmias according to Space weather dot etc. Please check their site for further information. Most commercial snow plow company's, are busy keeping parking lots clear for stores, etc. It would be difficult if not impossible to get them to shovel walks.

I think if you hire a snow removal company that has insurance, etc. then they would be holding the bag if someone got hurt in the snow. I don't know that for a fact though.
AllyM, I went to court today to pay the "failure to remove snow" ticket, for a total of $250. This was for the storm you mentioned. The company I hired didn't remove the snow in time, and then it froze and they had scrape the frozen mix away. The company then charged me $1,900 for the snow removal at the 4 houses. My plow company shovels the front and back stairs and walkways at one building when they are there plowing. It costs a little more but they will do it. The other building is tenant responsibility for their front steps and back porch. With 5 sets of stairs at that building it doesn't make sense. I provide complete snow removal, it just costs more money. I have lots of sidewalks my guys shovel. Than I drive around and call them to complain if its not done properly.
With the way attorneys advertise slip and fall lawsuits these days, and I mean advertise one had a massive billboard up on Rt1 all winter, I don't take any chances.
Around here it doesn't matter how big they are, I know the guy who does all of Yale, which is a massive account. They shovel walks. --69.117.xxx.xxx |

Even if that were to be legally permissible, it would only apply to the tenants. If a visitor were to fall, they could not be held to an agreement between a landlord and a tenant. --10.78.xxx.xxx |

I've seen it work for single family houses, but not apartments. With apartments it's harder to get the tenants to agree to what is their responsibility, because they aren't in control of the space. Once you have shard space, then getting someone to own it becomes difficult.
It's usually easier to hire someone and pass these costs along to the tenants. Just remember that if the tenant doesn't shovel, then you (the landlord) will be the one sued or receiving the fine from the city. --10.78.xxx.xxx |

My lease said the tenant was responsible for snow removal......but six years ago they didn't shovel and the snow turned to ice. When they fell and broke an ankle, it wasn't the tenant that filed on me - it was their insurance company.
