Years ago a tenant moved in with several kids at our large apt. he is disabled and had kept up with rent but now he has been struggling. I'm thinking that since all his kids are now adults that SS has cut the amount he is paid. I don't think he can afford this huge apt. He says he doesn't want to move.

Can I ask that he submitts what he now gets as his SS payment or is that a breech of some law? --71.192.xxx.xxx

You can ask but that doesn't mean he will have to or even be willing to provide proof of income.

Don't let his problems become your problems. If the rent is not paid in full on or before the due start serve a 4 day notice then if needed follow thru with a court summons. --72.93.xxx.x

I should proof read before submitting. That should have been a 14 day notice. --72.93.xxx.x

How do you know he is struggling? Is he not paying rent? Then it's time to start eviction proceedings. --173.22.xx.xx

If you find he's not going to be able to afford the rent, I'd end this tenancy as quickly as legally possible. It would be kinder to help him understand that he needs to adjust his lifestyle now vs. 6-12 months down the road when he's into you for $1000s of back rent and you have to evict him. --173.19.xx.xxx

Who cares how much he gets? he either pays the rent or he needs to move, don't get involved in his issues. Some people can pay me $550 when they only get $700 SSI check, others can't pay $550 if they get $3000 month --24.25.xxx.xxx

Ask for tax return. His ss income is on it. --73.33.xxx.xxx

Are all his kids (that SSI is no longer paying for) still living with him in the apt? If so, they shd be contributing money the rent for the roof over their heads. If not, then he doesn't need such a large place. He can't have it both ways.

But whatever way he goes--YOUR RENT gets paid--or he's out. Let him find something smaller and in line with his new price range. He doesn't WANT to move? Too bad, he has to live within his means. Better he learns it now than later.

Do what Steve says--he is the Mass guru around here. That 14 day notice will force your tenant to make a choice. --108.87.xx.xxx

Evict for the most common court case - unpaid rent, just follow the steps or hire a flat-fee eviction service and watch them so you can learn for yourself, legal services are the most costly hourly worker you will ever hire. --76.188.xxx.xx
