Hello All,

Group of 5 students rented house. Lease ended and as they left no forwarding info for SD, I sent 1 check made out to everyone to the property address. It was returned undelivered (they never set up forwarding). They left on good terms after several years.

One of the parents (not on the lease, only students on the lease) has been helping to move the process along. Once the 5 tenants realized that they were getting 1 joint check, they asked if I could make the check out to one of them instead, so they would not need to all sign it (all in different states now). I said as long as I had written confirmation from each of their email addresses confirming the request, I would do so.

They have all 5 sent a request from their own email addresses requesting that the check be made out to the parent that has been helping move the process along (not on lease).

Question: If I have all of the tenants email in confirming the change to have the funds returned to 1 person (not on lease), could I be opening myself up to any possible risk? My usual procedure is to have a blank that allows them to fill out who the SD should be made to at lease signing (they left it blank in this case) and I would technically allow someone to enter a third party there, if they so desired. This would basically be the same thing, except that it is via email after the fact. Thoughts? --172.72.xxx.xx

Thanks for the reply. I would, but there are two small issues with that.

1) When they moved in, they did not equally fund the Sd. I did not get into the specifics with them, as they were to provide 1 SD, so they worked it out between themselves.

2) Although they left on good terms, about 10% of the SD was withheld. I believe it was due to one kid in particular, but again, it was 1 SD and i feel like it is up to them to decide how they split it.

My normal operations in a situation such as this is to write one check and let them work it out, but yeah - when they all graduate and move it is tough.

As for not funded equally and most of with-holding due to one student, not your problem.

Since they have all emailed from a known email address that they want the check made to one parent, I would go with that. I always ask for all email addresses to be listed on my application, and when a new lease starts, I have them all sign an "update to application" that asks for a lot of what is on the standard application. The differences are that their previous LL isn't listed, since I don't need to check references. I do, however, ask for them to list, in writing, all room-mates, update phone number(s) and email address(es), update emergency contacts, employers, cars, etc. If I remember to do this every year, it really helps. --131.151.xx.xx

Yes, it was a joint lease. I only ever accepted payment from 1 auto draft. They worked it out between the 5 of them as to who paid what each month. I assume they split it evenly, but again, it was between them.

Barb, yeah, I agree. "As for not funded equally and most of with-holding due to one student, not your problem." It was a few years since they started the lease, but I recall them trying to pay different amounts. As with the rental payment, I told them I would accept 1 SD and it was up to them to work out who paid what between themselves. As such, I think dividing the amount by 5 and then sending it to them equally will only cause problems.

The biggest question at this point is, will there be any negative consequences for me, if I write a single check to one non-tenant, if all of the tenants agree to it, in writing? --192.175.xxx.xx

I deal with this since I rent to students. No point in making one check payable to five people. Not sure if anyone could cash it. I deduct from SD if any charges, then cut cks in equal amounts to each & send with an accounting of charges and disbursements. all to the people registered in a hse at time of leaving. I get all my new renters from referrals by old. I don't try to make it hard to be a good LL referral. --104.218.xxx.xx
