State Specific Question About: NEW YORK (NY) - preferably you have experience with NYC Rent-Stabilization

Hey everyone,

I'm coming to this forum on the recommendation of my father who is a landlord in Cincinnati. Growing up, I'd always see him on this website at home.

Anyway, I live in a rent stabilized apartment in New York City. For the last 3 years we've received the lease renewal form that lists the 1 or 2 year renewal option and has all the verbiage of rent-stabilization.

From all my research, the line for rent-stabilization is if your rent is $2700 or less. Ours the last 2 years has been $2632.75.

This year, the lease renewal form came and says our rent is going up to $2770.75 and we are not subject to rent stabilization.

However, I saw that the 2016-2017 lease renewal guidelines for rent-stabilized apartments once again has a 0% increase for rent-stabilized apartments (like last year).

So if we were rent-stabilized last year, why would this change? Is this just some sort of mistake by the building management company? If you don't think it is, what should we do other than bring it to their attention?

I'm worried that if we push them on it, they simply won't let us renew the lease. Then again, we're good tenants who have always paid on time (1 late fee in the whole 5 years of living in the apartment).

Rent stabilization means rent control as rent control has negative consequences. In the Us rent control is a municipal piece of legislation where in reality tenants always pay higher rent then a free market area as there is no new supply of rental housing. Like everywhere else most of us experience annual operating cost increases in taxes, water, sewage charges, natural gas, hydro electric along with new taxes like the carbon tax which means more is required to break even. In most urban areas provincial rent control vacancy rates in a lot major urban areas is approaching one per cent or less which means tenants will end paying more rent. The provincial government is going to extend rent control to new apartment buildings which means no more new construction of apartment buildings. In the province of Ontario every single government owned building is not under the rigid rent control where a tenant was upset about 45 per cent rent increase. Pay it or leave. Finally rent control was never design to control rents but bankrupt the private rental housing providers then the government becomes the one and only rental housing provider. NYC has very different rental laws from the rest of the united states. You should meet with a local legal aid group for helping tenants. They will know the local laws and help you understand what your rights are and what to do next.

There are other concerns besides the monthly rent that affect whether a unit is rent stabilized or not. If the developer of the building gets a certain tax credit your apartment will still be rent stabilized even over $2700. If you are in a rent stabilized apartment your rent should not have gone up either way though. Meet with a local tenants rights/legal aid group. --142.254.xx.xx

Mike, I'm up here in New Haven,and giving you a country boy's take on the problem.Many people I know live here and work in Manhattan.They live here although the taxes are astronomic.But they would rather get up a little earlier every day than pay those prices that you are paying for rent.why you could even buy a house ,pay your train fare,buy a car,for exploring the picturesque countryside at the weekend.Some of my friends have their own bands and are relocating to some of the local towns.But you have to move around a little.I lived in the Bronx when I first came here.Glad I got out of there.People that were born in the City don't know there is another world.
