I have a lovely 2br apt for rent in a 4 unit building. Tenants all get along great. They are all quiet adults who have been there a long time. Got a call from a woman who seemed reasonable. She talked about credit requirements, employment and mentioned her boyfriend. Foolish me waited until well into the conversation before asking "So who else will be living with you?" 3 kids all under 4yrs old!!! She says they share a room but my fear is a) they'll move out in a year to find more space or b) they'll STAY for several years and disrupt the quiet vibe and/or trash the place.
Can I legally say '5 people is too many for a 2br place???'

I count 5, the applicant, the boyfriend & 3 kids.
In MA the state sanitation code spells out the SF requirements per occupant. I believe HUD uses 2 per bedroom plus one. Unless PA has some similar code, I won't reject on the number of people. I'd be inclined to have her fill out an application & find another reason to not rent to her. --72.93.xxx.x |

Not so simple.
There are overlapping requirements, all of which need to be satisfied.
HUD says that familial discrimination exists if tenants are refused because of family size, unless space available is below their standard. Their standard is 2 persons per bedroom plus one more per unit. (For 2 bdrms, thats total of 5 persons).
There are also building code restrictions. CA for example says, must have 70 sq ft in a bedroom to house 2 persons, 50 additional sq ft for each additional person. Thats in a single bedroom.
There are also local fire codes, local discrimination codes, local building ordinances, etc. They must ALL be satisfied simultaneously.

I read it as 2 per beadroom plus one BORN DURING TENANCY.
Isn't there also something about gender. After certain age males and femaile must be in seperate rooms.

Check with your municipality to see if they have guidelines. If the info is not online and you must call, DON'T give them your name or property address, just say that you're considering renting out a place, and was wondering...
This may be a tester - be polite and friendly. If they ask, show them the place. Then screen both adults as thoroughly as you would for anyone else. I'm willing to bet that there is some good reason to table their application for not meeting your minimum standards.
