Have a tenant that prefers to park out front on city parking. Tenant previously had a dispute with resident. I spoke with resident and she is completely accepting that it is city property and regardless other available options, my tenant has as much of a right to park there as she does.

The issue I am having now is that whether on purpose my tenant is parking her vehicle as to where there is almost enough room on both ends to park a vehicle thought not quite enough. Residential area, so no actual designated spots.

I suppose my question is...is this more a situation where I should tell the resident that she just has to deal with it.

We are on monthly lease terms and do have in our lease:

Tenant shall not commit waste or nuisance, or annoy, molest, or interfere with any other Resident(s) or neighbor(s).

Is that standing ground to file a non-renewal or am I being unfair if it was sufficient ground to not renew the Lease?

You are correct. I made a novice decision. I suppose this is too silly of a question to be asking on a landlord help forum.

Not necessarily a silly question and I didn't mean it to sound like I was beating you up,just realize tenants,neighbors etc will turn to you in many cases to solve there problems that have nothing to do with landlording and you don't want to let there problem become your problem.They seem to think you have a magic wand you can wave and solve all there problems --24.25.xxx.xxx

Ken is just being honest. What answer were you looking for exactly? Everyone has a right to park on city property. If someone is electing to do so, I suppose you could try and get that specific space reserved for some specific reason temporarily.

Its just the nature of public property - its public.

I understand that in some tenants eyes, a parking space is golden if it theirs. It wasn't specifically said, but am I correct in assuming that you don't have enough parking of your own to keep both tenants happy? Turf wars are real - especially when asphalt is present

Patricia, feel free to come and ask for advice.

Ken gave you good advice. He did not tell you to go away, he advised you to keep out of the issue between the neighbor and your tenant. Ken was a little bit blunt, but you will get used to that!!

We have to figure out which problems are ours, and which are not. This one, the Tenant parking on the public street, is not your problem.

I would try to stay out of this dispute.

I once pulled into a public parking space -- along the curb of a public street -- because I had received a cell phone call. The occupant of the house I pulled in front of got very belligerent, threatened me, told me that he was a professional boxer and that he was registered as a deadly weapon. While brandishing a pistol, I told him that he just gave me justification to shoot him, but that that would create a lot of paperwork, and that I would instead finish my phone call and drive on. I later learned that this guy was a local drug dealer, and that he wanted "his" parking space free because it was used by his customers as a drive-through.

Parking space disputes can get ugly!

We had someone across the street from our apts complain about our tenants parking on the public street for several days when we were resurfacing the parking lot.

I don't think it's grounds for non-renewal. They can park as they wish on the street. If it were your parking area and it was causing issue, then maybe. Otherwise, it sounds like Sheldon just got used to parking in their "spot". --107.77.xx.xx

Ken, after already initiating myself into the dispute, I do completely understand where you are coming from with saying that.

Wasn't trying to get offended. Just young and new to this and am trying to find the correct resources for the appropriate inquiries.

Intitially, yes, her complaint was it was her usual parking spot. Told her my Tenant has just as much right as she does and to my tenant mention that there are plenty of extra spaces in the back though Tenant is welcomed to park in front if she pleases. It is her right.

Leave it alone for a day and Tenant car gets tagged for expired plates, not towed and my Tenant is cussing her out in front of her lawn and threatening to blow up her house and family and after having the police called for a neighborhood disturbance. Resident has the option of arresting tenant but chooses not to.

In a nutshell, tells Tenant she cannot behave like that and re-clarify to Resident that it's city parking.

It's not so much that she considers it her parking spot now, it's more that since that incident, my tenant has been parking as to where no other cars are able to park anywhere because she is parked in the middle.

Detailed expressed to my tenant that it's not the issue of parking in front, you are welcomed front or back just please try and be considerate of the other neighbors and efficiently utilize the space as to leave enough room for other vehicles if possible at time of parking. --173.19.xxx.xxx
