State Specific Question About: NEW JERSEY (NJ)

I filed for eviction and have a court date wensday. I would like to know if I should have sent my tenant a notice to quite letter for not paying rent before I filed with the court. --71.187.xxx.xx

This is a good time to print out your state and local tenant rules, place them into a 3ring binder so you can flip over for local rules, there will be some info on the correct forms and timing involved, getting to a investor meeting for your region is very helpful place to ask questions. --76.188.xxx.xxx

For problem tenants getting evicted is a way of life where they wait until the locks are changed then start another eviction all over again. Consider reporting them to credit bureaus once the locks are changed so when they start to look again the negative report will be recorded. Also make sure in future that a credit check is done on all adult applicants to completely avoid this situation again. --192.81.xx.xx

In many (most?) states, the LL is required to give notice to the T of non-payment. This is typically called a ___ Day Notice To Pay Rent Or Quit.

However, in NJ, the landlord is not required to give the tenant any type of notice before filing the lawsuit (see  New Jersey Stat. Ann. § 2:18-61.2).

So it looks like you may be fine here.

Just have a way to prove they didn't pay. Do you have a rent ledger where you mark down the payment each month? It sounds simple and stupid but I think it's important. They actually have to prove that they did pay with a canceled check or receipt though. Take the lease with you. --73.33.xxx.xxx
