State Specific Question About: FLORIDA (FL)

Hi All,

I have a troublesome tenant who makes false claims every month when rent is due. She keeps on telling the fridge is not working but when the fridge company calls to fix it she says that its working fine. But every month when the rent is due she says that the fridge is not working. This month she falsely claimed that the bank said she cannot deposit the rent to my account as there is something wrong with my bank account. When I called the bank the bank said its perfectly fine and the bank account is active. Their lease ends in Nov this year. It has become a headache to me now as every month she plays the same game. I really appreciate if you can share some tips of how to handle situations like this( I am a new to this renting thing) --98.165.xx.xxx

Is she paying the rent? If yes, she's a pain yes but just keep her until Nov then decide if you want her gone and don't renew her lease. Some customers are harder to deal with than others.

If she is not paying the rent....evict. Easy cheesy. She can show up to court and explain to the judge all of her false issues. Judges are smart. They recognize smoke screens like fake claims. Keep good records of every time she does this.

In my state, there is a very specific legal process for withholding rent, and none of this tenants actions to date would have been excused if she went to court. --173.19.xx.xxx

Buy a non contact thermometer along installing a special thermometer in the fridge and freezer. Take pictures of the temperatures of all thermometers to prove the fridge is working end of story. If they are persistently late then look at the eviction option. Also can get more specific help from a landlords association where Google to find one near the rentals. --74.220.xxx.xxx

Thank you so much for all your replies. Is it possible for me to do the eviction notice by myself without a lawyer. The rent is due on the 1st. In the lease it says if rent is not paid in 3 days then 4% late charge fee will be applied. I reminded her today and said I called the bank and the bank confirmed saying deposits can be made to my account. She has my address as well. but she never mentioned about sending a cheque or sending money through western union so that I can pick it up. According to your experiences how long should I give them before sending them the eviction notice.( today is the last day to pay the rent) --98.165.xx.xxx

If you want to evict, put a notice on her door the first day that you can (you will need to know what your local law saws - how long you have to wait after the first to post a Pay or Quit). If you have never done an eviction, GET A LAWYER who has done many of them in your locality. It's well worth it to make sure it's done right. One mis-step and you will have to start all over. Again, check what your local laws are, but most places you do not have to accept the rent once the three day notice expires and you can go ahead with eviction.

The other choice is to keep playing her games and then non-renew with a letter dated August 31. THEN if she doesn't pay rent, and she likely won't, you can evict.

OR you can give her a happy clause NOW. Tell her that she obviously is unhappy with the unit, and if she can be out within 30 days, you will release her from the lease with no repercussions. --134.179.xxx.xxx

Hi All,

I wanted to give an update on my tenant issue: She had deposited the rent couple of minutes ago. Thank you so much for all your replies once more. I was so upset having to deal with her games every month when the rent is due. There are indeed strange people in this world you enjoy been a pain to the others. I will wait until Aug 31st and send them a non-renewal notice. Because I don't want to end up playing her games next year as well. Thanks again. --98.165.xx.xxx

In my area, most property managers get 10%. Also, we are not allowed to charge a late fee unless the rent is ten days late. So here is what I do.

Say I can get 1000 dollars per month for my unit. A property manager would get 10% or 100 dollars leaving me with 900 cash in hand. I rent the unit for the same 1000 myself, but put in the contract that if the tenet pays me by the last day of the month (28 Feb) for the upcoming month (March), I give them a 100 dollar credit. So if the pay Feb 28 or before for March rent, it is 900 dollars. Pay on March 1st, it is 1000 dollars. Since I started that I have people looking for me to give me their rent money instead of waiting a day and I have to look for them. --68.131.x.xxx

We've heard the same on many occasions..... we give all tenants the same options: pay at the bank, pay online or pay me. If they do none of the above, they get written notice per state law. Most pay with late fee, once they get notice written notice. If they don't pay... they get evicted.

P.S you should treat all tenants the same... depending on your service area...most tenants know each other and talk..... --75.128.xx.xxx
