Probably the same as California, take the tenant to Liars I mean Small Claims court and plead your case. Be prepared to hear you were paid or you waived any deposit. The more you have in writing the better your chances. Some judges are pro tenant and anti landlord. --108.196.xxx.xx

FL rules have changed some since I left the Dania Beach, FL area however most of the rules are local about timing, waiver of deposit return without forwarding address - meaning if tenant did not leave new address then you send accounting statement to last known place (the unit where they lived) and then when you get the mail back unclaimed you hit the road block, using a skip search company may yield info but the costs rise doing this. --76.188.xxx.xxx

I don't know about FL, but here in Missouri I keep all tenant deposits in a separate FDIC insured account for Security Deposits only at the bank. I record all damages/charges on the deposit accounting statement, subtract that amount from their deposit, send them the statement and the remaining balance (if any). I then transfer to amount they owed me from the Sec Dep account into our regular checking. Click, click, done. Nothing to file. --173.19.xx.xxx

Georgia, I am with Shaun in not understanding fully your question. When you engage a tenant you take in a security deposit from them. YOU HAVE their deposit in your control. You have put it some acct, one would suppose.

-When the tenant leaves with damages, you add up the cost of the damages, subtract that from the amount you received and send them an accounting letter and a check for the remainder. If they owe you MORE than their security deposit covers, then you send them a letter with the accounting and a request for the difference still owed to you. TAKE PHOTOS OF THE CONDITION OF THE UNIT.

-If the amount owed is a great amount and they are refusing to pay it, THEN you take them to court. Have all your paid out receipts and estimates with you to show the judge. Take all the photos of the condition with you to show the judge.

-Personally, I usually do not take anyone to small claims court. In TX we are not allowed to garnish wages, so even if I had a judgement in my favor, I would likely not get any money from them. I do not throw good money after bad. I just keep all the sec deposit, make the repairs and move on. I do own a home in FL that has tenants, and I have a management service managing it. Occasionally I do have to keep the deposit and move on. As long as you have all the documentation showing the use of the deposit to make the house ready for new occupancy, you are covered as far as keeping the whoile deposit. --108.87.xx.xxx
