State Specific Question About: CALIFORNIA (CA)
the tenant was evicted. they damaged walls, leaving many large holes. they had some small animals that broke the carpet and left a lot of sand in the carpet. I am going to the small claim court. However, fearing not be able to get anything from them, I did most of the repair myself. How can I calculate the dollar amount with my time spent on repairing? --173.164.xxx.xxx |

In CA, if you or your employee did the work, you may charge a reasonable hourly rate for the time spent. Your accounting state must include the time spent and the reasonable hourly rate charged.

If you are a software engineer in Silicon Valley, then $200,000/year is about $4,000/week which is about $100/hour.
If you are not a software engineer in Silicon Valley, then you will have a harder time to justify that amount.

Find out what a local handyman service charges as an hourly rate and charge that amount. In the future modify your lease to state that any work done by you or an employee is billed at $XX per hour. I use $35 per hour in my lease. Ten years ago or so I was awarded $15/hour without having anything in my lease. I think the key is to be reasonable. --107.77.xxx.xx |

The law requires that the hourly fee be "reasonable".
An amateur generally cannot charge the same as an experienced professional, unless he can show that the time spent was equivalent to the time that a professional would spend. The hourly rate does not need to be listed in the lease. The charge must be "reasonable", not "agreed upon".
