State Specific Question About: CALIFORNIA (CA)
Can I evict section 8 tenants for serious damage not reported i8n time that includes roof leaks that have damaged 2 rooms and even floor in one room. The attorney didn't know what to do. Also, they threaten me with superior court litigation if I try have repairs made or deductions if I don't With water actively running into the bathroom both women yelled and threatened court because I was mistreating them by calling to say I could have a different tarp put on in a few hours. I'm not new to rentals but this is first section eight. I have to emphasis that I'm talking about two women who truth doesn't matter, laugh at me and won't even consider my leased to be legal. rankly I believe they targeted me for money. There isn't a behavior I can change. I need them out as soon as possible. They said in a letter if I take any action to correct the lease violations or attempt to evict they will sue me for actions that NEVER occurred. I just don't know but it seems best to give a 90 day notice for renovation and then renovate. I can't find an attorney in my small city that wants to handle section 8 terminations. I would like any advise anyone can offer. Thank you. I want to add she's consistent in her plans= in fact in September she told me she needed "punish me and give me a dose of my own medicine. I thought it was anger that would go away- it didn't. What had I done? I went to my rental for the 1st time in 2yrs. and ten months to make repairs required by the Housing Authority-all caused by them though I didn't say that to them. They're blowing smoke. I doubt you can charge them for the unreported damage. Ultimately, It's your roof, it's our leak, it's your damage. I would fix it and carry on. I would move these ladies out asap and make it look like it's not retaliation. If that requires sucking it up and hanging onto them for a few months, then so be it.

This difficult situation would recommend to contact a landlords association where there are listings on this site or Google to find near the rental unit. They maybe making allegations which are not true. If the roof is leaking a roofer can patch up. If the roof is at the ends of life then with one layer of shingles it is possible to install steel panels so there is no tear up. Many building supply stores and big box stores sell steel roofs. Shingles are a waste of money as shingles is like renting a roof. Finally a landlords association will be familiar with local laws and procedures to resolve this as these issues usually occur many times over and over again. --74.220.xxx.xxx |

Wow, new to managing a rental and also sec8,this is like jumping into shark infested waters with only a silk bathing suit, then an atty who does not know what to do. You really need to study your local and state tenant laws, then study the sec8 contract, get another atty in the meantime so you stand 1/100 of a chance to collect rent until the entire unit is repaired at your cost, you may have to put them into a hotel for a week while the interior is restored. Hopefully your can find a landlord group in your area and get some hints there before you open for business again. --76.188.xxx.xxx |

I've sucked up but they won't accept it. Whatever your political beliefs are these women are acting like some of the actors or students who hate the new President. Secondly, they are lying but do you mean I shouldn't proceed to terminate because they claim retaliation? Really important- what type of metal roof do you mean that a big box store would have? It is raining continually in northern California. Can't I wait awhile to reroof so the attic can dry? Also,I am only new to Hud. I have contacted and spoken with their representative at the Housing Authority and he tells me to get them out. I'm unsure because of their retaliation claim. It doesn't fit retaliation because it was their response to me for requesting money owed for 2 repairs that the LPA lease states are the tenants responsibility. If they are dry can't I wait? Do I need a notice to check the tarp from the outside? I realize this reply isn't totally in order but I am attempting to reply to three posts Someone suggested a motel and why? --69.12.xxx.xxx |

To Robert from Ontario Do you mean patch it now? If I did this then I could do a roof when it isn't raining. Ineed them to move before June because they won't take care of the AC or even admit they were negligent. She instead told me the technician was lying! I guess I just need to know if a patch until spring is enough? I've already lost and I'm treated like a servant but even that is too nice. I haven't encountered this before and I must not worry about it. Thank everyone who replied, Maggie

Suggest that you located an experience Section 8 Landlord and ask for assistance. The Housing office probably has a list of houses for rent with the owner/managers names and number on it. Contact these people and find one who is willing to advise you on issues. This is not legal help. It is survival help. You might also call several real estate offices and ask to speak with their property manager. They might be willing to meet with you and discuss options. Have your questions written down so that you do not waste time. Keep digging and you will get answers. Good luck! I am finding more crazies out there with Sec 8 tenants lately. --24.233.xxx.xx |

There are listings of landlords associations on this site. The state of California has more people living there then the population of this entire country. There are many landlords associations in the state. There is website for metal roofs which is metal roofs.com On You Tube there are videos on metal roofs. Metal roofs last from twenty to thirty years where with one layer of shingles wood strapping the bolt without a tear up. Here HD and Lowes sell metal roofs as a complete package. It is will be a little more then shingles but once down the metal roof will last longer along with standing up under severe weather conditions. Shingles are a disposal roof. In the house and other two apartment buildings had metal roofs installed. The house is much cooler on the hot days in the summer. --74.220.xxx.xx |

BINGO! I think you will find that written threat very helpful if this ends up in court.
Given the strange laws in CA, I do think you need the advice of a lawyer. If you can't find a lawyer in your small town, go over to the next bigger town. A lawyer can write letters and give advice without actually being there. --104.230.xxx.x |
