State Specific Question About: CALIFORNIA (CA)

My neighbor is trying to build a new fence between our property which was an open space until now.

According to county record, we both have 35’ in width. The funny thing is the whole is “less than” the sum of its parts; the measurement of both combine width comes out 68’ instead of 70’.

If we all compromise at 34' at out "new" property line, will this cause any problem in the future sale?

Any suggestions or pointers will be greatly appreciated.

One of my properties was built Exactly on the property line.

I need to ask permission to do work on that side of the house as neighbor (renter) has to unlock her gate and put her 3 dogs inside until I get the work done. Homes were built around 1940 ... no laws then on the property lines.

Have you tried finding locator pins anywhere on either property, using a pointed shovel you should poke into the soil at about 45 degrees where you think they should be, if nothing is found at any of the 6 corners in question best to have a survey - the new pins will have a special cap with the state registered civil engineer number on file. --76.188.xxx.xxx

It could cause a problem for future sales. When my owner next to my duplex went to sell her property, she (and I) found out her fence,retaining wall, and a corner of her house was built over the property line on my property.

She had to suspend her sale and we had to do a property line adjustment, which she paid for.

There are ways if both parties agree to file some form of corrective or confirmatory deed in some states. Due to a swap with a neighbor of previous owners, our deeds did not match so we were able to file something so that upon sale it wouldn't cause an issue. Mind you, we had closed and refinanced and the other property had been sold before anyone caught the swap in a title search. --73.253.xxx.xxx
