I own a mobile home in a park that I rented to my son. I want to sell it but he refuses to move out. I did not write up any agreement when I rented to him. The mobile home park told me it is my problem. What do I need to do? Right now I'm not receiving rent on time (which is only the money to cover park rent). --67.249.xx.xxx |

If it were me, I'd have a heart to heart with my son and explain how much I love him and how I'm about to paddle his butt (metaphorically) because I love him so much that I am no longer going to tolerate him lying to me and stealing from me. Then I would hand him his 30 day notice that I am terminating his rental agreement effective the end of February.
If he did not respond or fails to comply, then on March 1st I would introduce him to our county's legal system via papers served for eviction court.
I love my kids too much to let them grow up believing it is okay to break their promises, leech off their parents, and act like doofuses towards current and future land lords...so that's why I'd do that. It's not "tough" love...it's just love. --173.19.xx.xxx |

Kind of a tough situation to be in and one of the reasons why so many will "not rent to relatives or friends"...
Are you wanting to sell because your son isn't paying you or just because you want to sell?
Depending on your answer you could go with what Ken stated BUT - only if you want to be PAID and KEEP your son there. The 3 day Pay or Quit is just that - if he PAYS - he doesn't have to QUIT (leave).
If you just want him OUT - give him a 30 day notice. Since today is the 25th - I would do it now and have it effective as of February 28th as you need to give a full month (calendar month) - not the number of actual days to be out.
I would have either a lawyer or marshal serve the proper forms to ensure it is done accurately and there is no issue. Then after the 30 days (say March 1st) - if he doesn't move you (unfortunately) will need to go to court for what is called "holdover". Then the judge will end up most likely giving him anywhere from 72 hours to "whatever you can agree on" to get out.
If you go with the 3 day and he doesn't pay - you COULD get him out "sooner" - but not a guarantee - it would depend on when your courts are in session and when the next day is of court (and if you can serve him timely, etc). If you are in a village/town court - sometimes they only hold court for this 2x a month - you may want to find that out to "help" you.
Another "option" you have is to put it up for sale but indicate that they cannot disturb the tenant and will need to purchase sight unseen and it's up to the owner to deal with the tenant AFTER the close of sale - but that could be a bad thing for you too.

You would have to evict him, your son. Just so you know, when I went to evict a family of 11 who rented a 3 bedroom home on property I owned with 5 other homes -- people complained I was "heartless".
These tenants, who couldn't afford to pay me my rent was throwing a party with over 50 guests. The party screamed at me. SO I replied, I don't have to evict this family of 11, so long as everyone here gives me $20 a piece.
Not one person gave me so much as a penny. I no longer had complaints from other tenants or neighbors -- I'd stick out my hand and ask they to help offset the rent..... I ended up evicting them and told the judge the story......

First of all, mobile home laws are often different, so be sure you follow the mobile home laws!
Second, determine what kind of notices you need to give. Even if there is no WRITTEN lease agreement, you might have an oral rental agreement that allows you to evict on a simple Pay Or Quit Notice.
If not, if you were in MY state, you would have to give a Notice to Terminate Tenancy At Sufferance, followed by a Notice To Quit. The extra notice is not a big deal, but it delays the eviction for a bit. I do not know NY procedures.

Time for tough love. Either he can come up with the cash to buy the trailer from you and start paying rent
for the trailer parking space or you will evict him.
