Had court hearing for unlawful detainer for renter that didn't pay rent. Renter didn't show in court so I received a default judgement. My court time was 4pm and the judge came into the courtroom then and my renter wasn't there. He took the other case first because both parties were there so I was just a little disappointed that he gave my deadbeat renter a chance to show up late. All ended well because my renter never showed. Even if they did show I was prepared and it would have been a slam dunk case. Typical failure to pay rent and then bogus counterclaim to milk the process out longer. The one thing I'm not sure is if they can appeal because it's a default judgement. If they were there and lost they could appeal but I wonder if they lose their chance for an appeal because they didn't show. --216.93.xxx.xx |

It always irritates me when the judge enters the courtroom 15 minutes late. One tenant called the court to let them know that she was late. She showed up an HOUR late. Wonder if I would have gotten that latitude in lateness?? --24.233.xxx.xx |

In my state if the tenant doesn't show up the landlord has to wait a full hour before the judge can give the landlord a warrant. --24.25.xxx.xxx |

After waiting four months here the tenant put a stay on sheriffs order where they drag out the eviction for another additional two months. In province of Ontario it is probably one of the worst Landlord & Tenant acts in North America. Although one has the judgement if they do not work it is not enforceable. Here they hear all the people who show up first then sometimes it can take up two hours to finally have the adjudicator say one will receive a order in the mail. If a tenant goes through the system of dragging out evictions they live a year rent free by going through two rentals. --74.220.xxx.xxx |

Congrats! Sometimes the good guys win.
Many of ours do not show because they know what the outcome will be and are planning to file bankruptcy anyway. Why lose another day of work.
My judge starts hearings 10 minutes late to avoid "do overs" when someone complains about parking or troubke walking.
If someone misses the date and writes a letter he will have another hearing. He believes in letting everyone get their say in court. That keeps the peace and diminishes their anger.
I can only recall this happening twice. We just roll with it. The results are still the same.

YES.
The fact that the tenant did not make an appearance and you got a default judgment does not make her ineligible for any rights that she may have. That includes not only the right to appeal, but also to simply move to set aside the judgement because she had some reason why she did not show up: illness, forgetfulness, emergency, children, employment, etc. She can ask to set aside the judgment and receive a new trial, in addition to any rights of appeal.
I don't know anything about AL, but in this case, I don't think that I have to.

I'm not opposed to the Judge waiting or even coming into the courtroom late. I generally think about my parking meter when this happens.
I understand that landlords are not treated equally, they are often the target of cities and their growing fines.
I also know that in the jungle we call life, tenants are definitely not the lions. Nature will take care of us, survival of the fittest.

To follow up on what Moshe said.......and not knowing the state laws of Alabama,
In Pa, the tenant does not to attend the hearing to appeal either the possession or the financial judgement. In our state there are two separate time frames for the appeal process.
So yes you can raise your hands in victory as you won this battle - the tenant however still has possession of your home and can make you have some REAL bad days ahead. You will need to keep a close eye on this place to make sure your furnace and how water tank don't go for a walk.
