State Specific Question About: CALIFORNIA (CA)

I would like to not put myself in this situation again!

Resident gave 30 day notice and said they needed to leave 8 days after their 30 days. They did not want to move out if the next place wasn't ready yet if that was the case they would be homeless! The extra 8 days was done verbally. I was nice and arranged it with the new renters to come in on the 8th and not the 1st of the month. I also passed up on potential renters that could of moved in on the 1st. So now I got a text from the Residents moving out and they NOW let me know that they signed new lease with new landlords to move in on the 1st. They don't want to pay double rent for the 8 days they asked for. I now find myself loosing one weeks of rent. I normally have 0 days turnover or sometimes 1 day turn over time. Thanks to Mr. Landlord I know how!!! What can you all advise on how to keep it business and not playing Mr. Nice.

You should have gotten notice of intention to vacate in writing. Then, sent a letter that you accept their intention. THEN, tenants are no longer legal occupants of the property after the noticed date, and you can move to evict without further delay. Of course, eviction will take longer than the additional time that the tenants are asking for, but this puts the tenants into a formal, legal position that imposes certain requirements on them, and is more likely to be complied with. Plus, landlord is entitled to rent according to contract until noticed date, and holdover rent until they actually leave.

I do one-year leases, and I have had various requests from even good tenants, to stay a little longer. However, I do not accept extensions for less than a full year, even for tenants that I appreciate. So, I stand firm on my requirement and tenants must look elsewhere for housing until they are ready for whatever reason they needed their vacation time extended.

You said you did this verbally, but do you have anything in writing like a txt message confirming that they want to stay 8 extra days and you agree? I would withhold the 8 days of rent from the security deposit as agreed verbally in either case. If you do not have sufficient security deposit to cover the 8 days of rent and any damage I would speak with a local lawyer familiar with your court about what a local judge will accept. A verbal agreement is still an agreement but without any proof a judge may not take your word over theirs if you do need to sue the tenant. --75.149.xx.x

When they asked for 8 days I would have told them then you are asking to stay another month and I expect to be paid for another month,I am not a hotel,I don't rent by the day. --24.25.xxx.xxx
