hello fellow landlords.I bought a townhouse and now 1 by 1 the city is tearing down the buildings in the complex,the hoa will not fix anything but i pay assoc fee,yet if i dont they pay a lawyer to ask the tenant for rent and it is hard to sell the unit.who do you think can help --184.89.xx.xxx |

Is your unit going to be torn down? iS the entire complex slated to be torn down? I would attend their board meeting and find out just what is going on and how far it is going and what the long term plan is.
I don't quite understand your statement about.... yet if i don't they pay a lawyer to ask the tenant for rent...
Are you meaning the Complex is paying a lawyer to send a letter asking for the monthly association fee, cause you didn't pay it?
Certainly it would make it difficult to sell. May be best to wait it out. How are your holding cost? Property Tax? What is the length of the lease you have with your current tenant? --173.127.xxx.xx |

Do you have a copy of the HOA agreement, rules and regulations? Are you in the area, and can you get to the board meetings? Do they HOLD board meetings? Do they publish when the board meetings are?
If they don't hold them or don't publish them, send a formal request to the president of the HOA, copied to the management company, asking to be notified of the next board meeting.
Are you sure it is the city tearing down the buildings? Why are they doing so? Are they blighted? Falling down? You need more info. --131.151.xx.xx |

Yes the hoa is paying a lawyer to ask for rent when i dont pay fees.According to the hoa president,when I spoke to him last year they intend to remodel sectios 1 and 3.there 3 sections in the complex.He told me sec two has no problem and will be remodeled last but they tore down a bldg across from mine late last year.property tax is less than $200 a year and just have a yearly lease .holding cost is

I live close in order to get to the unit or any meeting but the only meeting notice i get is for when they need votes for changing board members.i guess i need to verify but it was the city trucks i saw when they took down the last bldg and no the bldgs are not falling.In section one they renovated some of those bldgs then they knocked down one --172.58.xxx.xx |

It sounds like the HOA has an order for garnishment of your rental/investment income because you are behind on HOA payments. A garnishment is better in the end for you than foreclosure.
Buildings do not just get torn down for no reason. If the city is tearing them down it is generally that they are unsafe to live in and have been condemned. If that is the case there should be many notices posted by the city or county.
If they are being torn down for a redesign/remodel it would require the board and members to vote and approve it, or for someone to buy out the owners of the to be demolished units. In any case these things do not happen overnight. If it is at the state of buildings being torn down it is going to take a lot of work to stop that process.
My advice would be to sell the property, lower the price if it is not selling at your asking price. If you are not interested in selling the property you need to get to the bottom of why the other buildings are being demolished. --75.149.xx.x |
